1. These regulations may be cited as the Local Government Finance Authority Regulations

1987.

2. All regulations previously made under the Local Government Finance Authority Act 1983,

are revoked.

3. In these regulations—

"the Act" means the Local Government Finance Authority Act, 1983:

"the Authority" means the Local Government Finance Authority of South Australia.

4. For the purposes of paragraph (c) of the definition of "prescribed local government body" in section 3 of the Act, the bodies set out in the schedule are prescribed.

5. (1) For the purposes of section 24(5) of the Act, the fees set out below are prescribed in respect of guarantees of the Treasurer relating to money borrowed by, or deposited with, the Authority—

(a)

for money borrowed by or deposited with the Authority between 26 January, 1984, and 30 June, 1985, inclusive (other than by way of loans or deposits from councils for terms of less than 6 months)—a fee of 0.025 per cent of the average daily amount of the Authority’s debt outstanding from those borrowings or deposits;

(b)

for money borrowed by or deposited with the Authority on or after 1 July, 1985—

(i)

as to money borrowed from or deposited by South Australian councils—a fee of 0.0125 per cent of the average daily amount of the Authority’s debt outstanding from those borrowings or deposits;

(ii)

as to money borrowed on the issue of promissory notes which mature before 30 June in the financial year in which they are issued—a fee of 0.0125 per cent of the average daily amount of the Authority’s debt outstanding from those borrowings;

(iii)

for any other money borrowed by or deposited with the Authority—

(A)

as to money borrowed by or deposited with the Authority and lent to or invested in the securities of South Australian councils or prescribed local government bodies—

(I)

a fee of 0.025 per cent of the average daily amount of the Authority’s debt outstanding from those borrowings or deposits; or

(II)

a fee of 50 per cent of the difference between the rate of interest which the Authority pays on those borrowings or deposits and the rate of interest which the Authority receives on those loans or investments,

whichever is the lesser; and

(B)

as to money borrowed by or deposited with the Authority and invested

with any other body—

(I)

a fee of 0.0625 per cent of the average daily amount of the Authority’s debt outstanding from those borrowings or deposits; or

(II)

a fee of 50 per cent of the difference between the rate of interest which the Authority pays on those borrowings or deposits and the rate of interest which the Authority receives on those loans or investments,

whichever is the lesser.

(2) The fees set out in this regulation must be calculated over a period of 3 months ending on 15 March, 15 June, 15 September and 15 December respectively in each year and are payable on 31 March, 30 June, 30 September and 31 December respectively in each year.

(3) This regulation is subject to any agreement in writing between the Authority and the

Treasurer.

(4) The last period in relation to which fees will be calculated under this regulation is the period from 16 March 1995 to 31 May 1995.

6. (1) The following fees are prescribed under section 24(5) of the Act in respect of each period of three months ending on the last day of August 1995 and thereafter on the last day of November, February, May and August in each year:

(a)

0.0625 per cent of the average daily amount owing during the relevant three month period in respect of money borrowed or accepted on deposit from councils or prescribed local government bodies; and

(b)

0.1 per cent of the average daily amount owing during the relevant three month period in respect of money borrowed or accepted on deposit from any other person.

(2) Subregulation (1) applies subject to any agreement in writing between the Authority and

the Treasurer.

(3) The fees referred to in subregulation (1) are payable by 21 September 1995 and thereafter by 21 December, 21 March, 21 June and 21 September in each year.
