An Act to Enable Local Authorities to Raise LOTHCEAL Revenues to meet Unforeseen Expenditure for GOVERNMENT ~ 'INANCE ACT OF 1950. the Financial Year commenced on the First Day of July, one thousand nine hundred and fifty. [ASSENTED TO 8TH DECEMBER, 1950.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. (1.) This Act may be cited as "The Local : ~ ~ struction. Government Finance Act of 1950." (2.) This Act shall be read and construed with *" The Local Government Acts, 1936 to 1949," and, in relation to Brisbane City Council, t" The City of Brisbane Acts, 1924 to 1949." Meaning of terms. 2. In this Act-. (a) The term "Local Authority" includes "Brisbane City Council" ; (b) The term "the Act" means, in relation to Brisbane City Council, t" The City of Brisbane Acts, 1924 to 1949," and i~ relation to any other Local Authority, *' 'The Local Government Acts, 1936 to 1949 " ; and * l G. (c) The term "present year" means the year within the meaning of *" The Local Government Acts, 1936 to 1949," commenced on the first day of July, one thousand nine hundred and fifty. 3. (1. ) Notwithstanding any provision of the Act, Supplemen- a Local Authority may, and is hereby authorised to, ~~? ~~~ ~ frame and adopt a supplementary budget, for the present r~~~-1951. year for all or any of the Funds establIshed and kept under the Act. (2.) In the supplementary budget for a Fund the Local Authority shall show separately for each and every item, the respective amount by which, consequent on the increase in the basic wage, it is estimated that expenditure on that item in respect of the present year will exceed the disbursement therefor as provided for in the budget already framed and adopted for the present year. (3.) For the purposes of the Act, a supplementary budget shaH be deemed to lawfully vary the budget for the present year as framed and adopted by a Local Authority and that lastmentioned budget as so varied shall become and be the budget of that Local Authority for the present year. 4. (1.) Every Local Authority which frames and Supplemen- adopts a supplementary budget shall and, notwithstanding ! ~ 1 : h! ~ ; es. anything contained in the Act or in any other Act, is hereby authorised to make for the present year supplementary rates, or charges, or rates and charges founded on and sufficient in amount to balance the supplementary budget. (2.) Every such supplementary rate or charge may be levied in the like manner as the rate or charge thereby supplemented. The whole or any part of the amount thereof may be so levied separately or together with the amount, or any part of the amount, of the rate or charge thereby supplemented. (3.) The provisions of the Act and of any other Act applicable to and with respect to the making, levying, payment and recovery of a rate or charge shall, subject to this Act, extend to and with respect to the making, levying, payment and recovery of any rate or charge supplementary thereto authorised by this Act. * 1 G. 6 No. 1 and amending Acts.
