Local Government (Elections) Amendment

Regulations (No. 2) 2005

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Local Government (Elections)
Amendment Regulations (No. 2) 2005.

2.             The regulations amended

The amendments in these regulations are to the Local
Government (Elections) Regulations 1997*.

3.             Regulation 26 amended

Regulation 26(4) is amended by deleting “of the local
government” in the first place where it occurs.

4.             Regulation 27 amended

Regulation 27(5) is amended by deleting “31st” and inserting
instead —
“ 38th ”.

5.             Regulation 28 amended

Regulation 28(3) is amended by deleting “is to be charged to the
local government’s trust fund.” and inserting instead —

or (1a) is to be charged to the fund or account to which
the candidate’s deposit was credited under

regulation 26(4).

”.

6.             Regulation 89 amended

Regulation 89(3) is amended by deleting from “Where — ” to
the end of paragraph (b) and inserting instead —

Where the Electoral Commissioner is to be responsible

for the conduct of a poll, other than an electoral poll,

”.

7.             Schedule 1 amended

(1) The amendments in this regulation are to Schedule 1.
(2) Form 2 is amended under the heading “Back of Form 2” in the
box entitled “Duration of enrolment of occupiers” by deleting
“remain valid for the next 2 (or in limited circumstances, next 3)
ordinary elections held for your electorate.” and inserting
instead —

expire in accordance with section 4.33 of the Local Government Act 1995
(this will usually be 6 months after the holding of the second ordinary

election after your claim was accepted).

”.

(3) Form 3 is amended in the box entitled “Duration of enrolment
of occupiers” by deleting “remains valid for the next 21
ordinary elections held for your electorate.” and inserting
instead —

expires in accordance with section 4.33 of the Local Government ordinary election after your claim was accepted).

”.

(4) Form 3 is amended by deleting from “Notes to Form 3” to the
end of the form.

Form 8 is amended under the heading “Back of Form 8” in the box entitled “Closing date for nominations” by deleting “30th” and inserting instead —

“ 37th ”.

Form 9 is amended under the heading “Back of Form 9” in the box entitled “Closing date for nominations” by deleting “30th” and inserting instead —

“ 37th ”.
(7) Form 20 is repealed and the following form is inserted
instead —
