Local Government (Elections) Amendment

Regulations 2001

Made by the Governor in Executive Council.

1.            Citation

These regulations may be cited as the Local Government
(Elections) Amendment Regulations 2001.

2.            The regulations amended

The amendments in these regulations are to the Local
Government (Elections) Regulations 1997* .

3.            Regulation 11 amended

After regulation 11(1) the following subregulation is inserted —

(la) The CEO may require the written notice referred to in
subregulation (1) to be incorporated into Form 2 in

4.            Regulation 24 amended

(1) Regulation 24(b) is amended by deleting "information about the
proposed candidate" and inserting instead -

biographical information about the proposed
candidate and statements of the candidate's

policies or beliefs

(2) Regulation 24(e) is amended as follows:
(a) by deleting "recent";
(b) by inserting after "shoulders" -

before the date of the nomination form or the

if the photograph was taken less than 6 months reasonable likeness of the proposed candidate

5. Regulation 72 amended
After regulation 72(c) the following paragraph is inserted

(ca) is not to record

(1) the name of a person who presents

himself or herself to an electoral officer
at the polling place to obtain a ballot

paper; or

(ii) any other information provided by that

person under regulation 61(2)(b);

6.            Schedule 1 amended

Schedule 1 is amended in the List of Forms in the item relating to Form 2 by inserting after "Claim" the following -

incorporating Notice of Nomination of co-owners or
co-occupiers (if required by CEO)

7.           Form 2 amended

(1) The heading to Form 2 is amended by inserting after "Claim"

the following -

incorporating Notice of Nomination of co-owners or
co-occupiers (if required by CEO)

(2) Form 2 is amended after the box relating to "Claim and

Declaration" by inserting -

Local Government Act 1995, s. 4.31(2)

CO-OWNERS OR CO-OCCUPIERS

Note: if under regulation 1 1 (la) of the Local Government (Elections)
Regulations 1997 the CEO requires the written notice of a nomination under
section 4.3 1(1)(e), (t) or (g) of the Act to be incorporated into Form 2, the notice is
to be inserted at this part of Form 2 in such form as the CEO requires and signed

in accordance with regulation 11 (2) of those regulations.

(3) Form 2 is amended on the back of the form in the box relating to

"Silent address" as follows:

(a) by inserting after "address" in the first 2 places where it occurs -

(b) by inserting after "shown" -

(4) Form 2 is amended on the back of the form in the box relating to

"Which ward" by deleting "chose" and inserting instead -

" choose ".
(5) Form 2 is amended on the back of the form in the box relating to
"Nominations" by inserting after "form" -

(6) Form 2 is amended on the back of the form in the box relating to

"Duration of enrolment" as follows:

(a) by inserting after "enrolment" - " of occupiers ";

8.           Form 3 amended

Form 3 is amended in the box relating to "Duration of enrolment" as follows:

(a) by inserting after "enrolment" - " of occupiers ";

9. Form 14 replaced
Form 14 is deleted and the following form is inserted instead -
Form 14. Elector's Certificate

Local Government (Elections) Regulations 1997, reg 43(1)(e)

Elector's Certificate

Declaration I am the elector to whom a package containing the
[Making a false accompanying' ballot paper envelope was addressed. I declare
declaration is an that the accompanying' ballot paper envelope contains my ballot
offence] paper(s).

1 Declaration

If the elector's certificate is:

(a)

attached to the ballot paper envelope, replace "accompanying" with "attached"; or

(b)

printed on the return envelope, replace "accompanying" with "enclosed".

10.         Form 18 amended

(1) Form 18 is amended on the back of the duplicate copy of the

form in the box relating to "What you may do" as follows:

(a) by deleting "and" after "votes;";
(b) by inserting after the second dot point -

IE

be present at the preparation of postal voting papers but only at a sufficient distance so that you cannot ascertain the markings on the ballot papers; and

(2) Form 18 is amended on the back of the duplicate copy of the

form in the box relating to "What you must not do" as follows:

(a) by deleting the full stop and inserting a semicolon

instead;

(b) after the last dot point by inserting —

record the name of a person who attends a polling place to vote or record any information given by a person to an electoral officer in order to receive a ballot paper.

11.          Form 22 amended

(1) Form 22 is amended on the back of the form in the box relating
to "Ward" by deleting "in being" and inserting instead —

(2) Form 22 is amended on the back of the form in the box relating
to "Cast your vote" by deleting "placing".
