2 Local Government Court Rules Amendment (No. 1) No. 25, 1994 ˙ Short title 1. This regulation may be cited as the Local Government Court Rules Amendment Regulation (No. 1) 1994 . ˙ Commencement 2. This regulation commences on 4 February 1994. ˙ Amended rules 3. The Local Government Court Rules 1966 are amended as set out in this regulation. ˙ Replacement of s 38 (Fees) 4. Section 38— omit, insert— ˙ ‘Fees ‘38.(1) The fees set out in the Schedule are the fees payable for the matters specified. ‘(2) The fee for taxing a bill of costs is payable— (a) if a certificate of taxation is required—on signing the certificate; or (b) if a certificate is not required—on the allowance of the bill of costs. ‘(3) The amount payable is fixed by the Registrar— (a) on the amount of the bill as taxed; or (b) on the amount of the part of the bill that may be taxed. ‘(4) The Registrar may require a deposit on account of fees, before taxation, of not more than the fees on the full amount of the costs as submitted for taxation. ‘(5) If a deposit is paid, the Registrar must make a note of the deposit paid on the bill of costs. ’.
