2 Local Government (Correction of Errors) No. 383, 1992 PART 1—PRELIMINARY ˙ Short title 1. This order in council may be cited as the Local Government (Correction of Errors) Order 1992 . ˙ Purpose 2. This order in council sets out corrections for the purpose of curing irregularities in by-laws made by the Council of the Shire of Crow’s Nest and the Council of the City of Townsville. PART 2—CROW’S NEST SHIRE COUNCIL ˙ Corrected by-law 3.(1) By-law 51 of the By-laws of the Council of the Shire of Crow’s Nest is corrected as set out in this Part. (2) In this section— “By-law 51” means the by-law that was— (a) made by the Council of the Shire of Crow’s Nest on 26 October 1990; and (b) approved in part by the Governor in Council on 18 April 1991; and (c) published in the Gazette on 20 April 1991 at pages 2504 to 2505. ˙ Correction of s.2 4.(1) Section 2 (definition “Clear” )— omit. (2) Section 2 (definition “Council” )—

(3) Section 2 (definition “Damage” , after ‘ includes ’ )— insert ‘ cutting down, removing, ’. ˙ Correction of s.3 5.(1) Section 3(a)(i)— omit ‘ exclude ’, insert ‘ include ’. (2) Section 3(a)(i)— omit ‘ and ’. (3) Section 3(a)(ii)— omit ‘ include ’, insert ‘ exclude ’. (4) Section 3(a)(ii)— omit ‘ . ’, insert ‘ ; and ’. ˙ Correction of s.4 6.(1) Section 4(c)(i)— omit— ‘ include in the Catalogue, an area as a Tree Preservation area, the Shire Clerk shall given written notice of the Council’s intention to the registered proprietor of the land on which the tree, group of trees or Tree Preservation area is situated. ’, insert— ‘ make an inclusion in the Catalogue or the Register, the Shire Clerk shall give written notice of the Council’s intention to the registered proprietor of the land on which the subject matter of the proposed inclusion is situated. ’. (2) Section 4(c)(iii)— omit— ‘ include species of trees on the Register or when the Council intends to include in the Catalogue a Tree Preservation area, ’,

(3) Section 4(c)(vi)— omit ‘ species of trees are ’, insert ‘ a tree or group of trees is ’. ˙ Correction of s.5 7.(1) Section 5(a)(iv)— omit ‘ directly or indirectly ’. (2) Section 5(a)(iv)(a)— omit ‘ roads of ’, insert ‘ roads or ’. (3) Section 5(b)(i) (after ‘ including ’ )— insert ‘ a ’. (4) Section 5(c)— omit ‘ paragraph (ii) ’, insert ‘ paragraph (i) ’. (5) Section 5(c)(i)— omit ‘ ; and ’, insert ‘ ; ’. (6) Section 5(c)(ii)— omit ‘ groups ’, insert ‘ group ’. (7) Section 5(c)(ii)— omit ‘ and ’. PART 3—TOWNSVILLE CITY COUNCIL ˙ Corrected by-law 8.(1) Chapter 40 of the By-laws of the Council of the City of Townsville is corrected as set out in this Part. (2) In this section— “Chapter 40” means the chapter inserted in the By-laws of the Council of

5 Local Government (Correction of Errors) No. 383, 1992 the City of Townsville by a by-law that was— (a) made by the Council on 16 October 1990; and (b) approved by the Governor in Council on 20 June 1991; and (c) published in the Gazette on 22 June 1991 at pages 881 to 883. ˙ Correction of s.1 (Definitions) 9.
