216 Local Government ( Chinatown Mall) Act Amendment Act 1989, No. 22 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Local Government (Chinatown Mall) Act Amendment Act 1989. (2) In this Act, the Local Government (Chinatown Mall) Act 1984- 1987 is referred to as the Principal Act. (3) The Principal Act, as amended by this Act may be cited as the Local Government (Chinatown Mall) Act 1984-1989. 2. Commencement . (1) Section 1 and this section shall commence on the day on which this Act is assented to for and on behalf of Her Majesty. (2) Except as provided by subsection (1), this Act shall commence on a day appointed by Proclamation. 3. Amendment of s. 2. Arrangement . Section 2 of the Principal Act is amended by omitting the expression "PART IVA-PROMOTION COMMITTEE (ss. 27A-27E);". 4. Amendment of s. 3. Interpretation . Section 3 of the Principal Act is amended by omitting the definition "the Promotion Committee". 5. Amendment of s. 14. Operation etc . of Mall. Section 14 of the Principal Act is amended by omitting subsection (4). 6. Amendment of s. 20. Establishment of committee . (1) Section 20 of the Principal Act is amended in subsection (2) by- (a) omitting the words "7 persons as follows:"; (b) inserting in paragraph (e) after the word "Minister" the words "as a representative of the Department of the Government for the time being charged with the administration of this Act"; (c) omitting paragraph (f) and substituting the following paragraph:- "(f) such other persons appointed by the Council on the nomination of the Minister as ensures that a majority of persons constituting the Committee are members of the Chinese community.". (2) Upon the commencement of section 6, the Chinatown Mall Advisory Committee constituted immediately prior to that commencement under section 20 of the Principal Act shall be dissolved and, notwithstanding section 21 of the Principal Act, the members of that Committee shall go out of office. 7. Amendment of s. 22. Deputy of members . Section 22 of the Principal Act is amended by numbering the existing paragraph as

Local Government (Chinatown Mall) Act Amendment Act 1989, No. 22 217 subsection (1) and inserting after that subsection the following subsection: "(2) A person shall not be appointed to act as a deputy of a member appointed pursuant to paragraphs (c), (d) or (f) of section 20 (2) unless he is eligible to be a member of the Committee under the relevant paragraph.". 8. Amendment of s. 23. Removal of members of Committee . Section 23 of the Principal Act is amended by omitting the words "the member" and substituting the words "a member". 9. Amendment of s. 25. Meetings and quorum . Section 25 of the Principal Act is amended in subsection (3) by omitting from the second paragraph the words "Four members of' and substituting the words "A majority of the members for the time being constituting". 10. Amendment of s. 27. Function of Committee . Section 27 of the Principal Act is amended by- (a) inserting in the note to the section after the word "Function" the words "and power"; (b) omitting subsection (1) and substituting the following subsection:- "(1) The function of the Committee shall be- (a) the furnishing to the Council of information and advice on matters- (i) relevant to the exercise by the Council of its powers under sections 14 and 15; or (ii) referred to it by the Council concerning the exercise by the Council of any of its other powers conferred by this Act; and (b) where the Council enters into arrangements with any person to perform on its behalf any things necessary for or incidental to the management, maintenance, cleaning, operation, promotion, development or use of the Mall, the furnishing to the Council of information and advice on the manner in which the arrangements entered into are being conducted."; (c) inserting after subsection (4) the following subsection:- "(5) For the purpose of ascertaining information and formulating advice to be furnished under this section, the Committee may require any person to furnish relevant information which that person is capable of furnishing and the person, so far as he is able, shall comply with the request.". 8

(1) The Principal Act is amended by repealing the heading "PART IVA-PROMOTION COMMITTEE" and sections 27A to 27E both inclusive. (2) Upon the commencement of this section, the members of the Chinatown Mall Promotion Committee constituted under section 27A of the Principal Act shall go out of office.
