Local Government ( Chinatown Mall) Act Amendment Act (No. 2) 1987,,No. 79 1069 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as.follows:- 1. Short Title . This Act may be cited as the Local Government (Chinatown Mall) Act Amendment Act 1987 (No. 2). 2. Citation . (1) In this Act the Local Government (Chinatown Mall)Act 1984 as amended by the Local Government (Chinatown Mall) ActAmendment Act 1987 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Local Government (Chinatown Mall) Act 1984-1987. 3. Amendment of s. 2. Arrangement . Section 2 of the Principal Act is amended by inserting after the heading "PART IV-ADVISORY COMMITTEE (ss. 20-27);" the heading "PART IVA-PROMOTION COMMITTEE (ss. 27A-27E);". 4. Amendment of s. 3. Interpretation . Section 3 of the Principal Act is amended by inserting after the definition "the Court" the following definition:- "the Promotion Committee" means the Chinatown Mall Promotion Committee established under this Act;". 5. Amendment of s. 14. Operation etc. of Mall. Section 14 of the Principal Act is amended by adding at the end of the section the following subsection:- "(4) In exercising its power of promotion of the Mall the Council shall have regard to any information or advice furnished in respect thereof by the Promotion Committee.". 6. Amendment of s. 27. Function of Committee . Section 27 of the Principal Act is amended in subsection (1) by omitting paragraph (a) and substituting the following paragraph:- "(a) relevant to the exercise by the Council of- (i) its powers under section 14 except the power of promotion; and (ii) its powers under section 15;". 7. New Part IVA. The Principal Act is amended by inserting after section 27 the following heading and sections:- "PART IVA-PROMOTION COMMITTEE 27A. Establishment of Promotion Committee. (1) There shall be a committee to be known as the Chinatown Mall Promotion Committee.

1070 Local Government ( Chinatown Mall) Act Amendment Act (No. 2) 1987, No. 79 (2) The Promotion Committee shall consist of 7 persons as follows:- (a) an officer of the Department of Local Government, nominated by the Minister; (b) a person , nominated by the Council; (c) 5 persons, nominated by the Minister as represen- tatives of the Chinese community in Brisbane. (3) Appointment as a member of the Promotion Committee shall be by the Minister by notification published in the Gazette. 27B. Tenure of office . (1) A member of the Promotion Committee shall hold office as such for the term specified in the notification of his appointment. (2) A member appointed to fill a casual vacancy in the office of a member of the Promotion Committee shall hold office for the unexpired portion of the term of office of the member in whose place he was appointed. (3) A person whose term of office as a member of the Promotion Committee has expired is, subject to his being duly nominated, eligible for re-appointment. 27C. Business and meetings . (1) The members of the Pro- motion Committee shall, from time to time as is necessary, appoint one of their number to be the chairman for a term specified in the appointment. The chairman shall preside at every meeting of the Pro- motion Committee at which he is present and, in the event of his absence, the members present shall, from amongst their number, elect a member to preside at that meeting and at that meeting the member, while so presiding, shall have and may exercise and discharge all the powers, duties and functions of the chairman. (2) Business shall not be conducted at a meeting of the Promotion Committee unless a quorum is present. Four members, of whom one at least shall be a member pursuant to paragraph (a) or (b) of section 27A (2), shall constitute a quorum at a meeting. (3) A decision evidenced by the majority of the votes cast by members present at a duly convened meeting of the Promotion Committee shall be the decision of the committee. The person who presides at any meeting shall have a casting vote in the event of an equality of votes in respect of any business before the meeting. (4) The Promotion Committee shall cause accurate minutes to be kept of proceedings at its meetings. (5) The Promotion Committee may meet at such times and, subject to this section, may conduct its business in such manner as it determines from time to time. .

The Council- (a) shall provide an officer to be secretary to the Pro- motion Committee; and (b) shall meet any costs incurred by the Promotion Committee with the prior approval of the Council. 27E. Function of Promotion Committee. The function of the Promotion Committee shall be the furnishing to the Council of information and advice on the promotion of the Mall.".
