An Act to amend the Local Government (Building and Miscellaneous Provisions) Act 1993

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Local Government (Building and Miscellaneous Provisions) Amendment Act 2007 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Local Government (Building and Miscellaneous Provisions) Act 1993 is referred to as the Principal Act. 4Sections 105A and 105B insertedAfter section 105 of the Principal Act , the following sections are inserted in Division 5: 105AAmendments to sealed plans sealed under Local Government Act 1962 Sections 103 and 104 apply to sealed plans that have taken effect under section 464 of the Local Government Act 1962 as if they were sealed plans made under this Act. 105BValidation of amendments to certain sealed plans Amendments made in accordance with sections 103 and 104 to plans sealed under the Local Government Act 1962 are valid and effectual only to the extent that the amendments were made in accordance with the powers conferred on a council under those sections in respect of plans sealed under this Act.
