LOCAL GOVERNMENT AND CATTLE SLAUGHTER- ING AND DISEASED ANIMALS AND MEAT (AMENDMENT) ACT.

Act No. 36, 1956.

An Act to make further provisions as to the regulation of the sale of meat in certain local government areas and the qualifications for civic office; for these and other purposes to amend the Local Government Act, 1919, and the Cattle Slaughtering and Diseased Animals and Meat Act, 1902, as amended by subsequent Acts; and for purposes connected therewith. [Assented to, 9th November,

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of New South

Wales in Parliament assembled, and by the authority of the same, as follows :—

1 . (1) This Act may be cited as the "Local Govern­ ment and Cattle Slaughtering and Diseased Animals and Meat (Amendment) Act, 1956."

(2) The Cattle Slaughtering and Diseased Animals and Meat Act, 1902, as amended by subsequent Acts and by this Act, may be cited as the Cattle Slaughtering and Diseased Animals and Meat Act, 1902-1956.

2. The Local Government Act, 1919, as amended by subsequent Acts, is amended—

(a)

by inserting at the end of paragraph (1) of subsection five of section thirty the following word and new paragraphs:—

" o r

(m)

the leasing or the purchase on extended terms of payment from the council by him of dwellings, shops, or other build­ ings under the provisions of section four hundred and ninety-six of this

Act; or

(n)

the acceptance of an advance from the council by him under the provisions of section 496A of this Act for the purpose of erecting a dwelling or for the purpose of reconditioning, rebuilding, or adding to any existing dwelling; or

(o)

the making by him of a loan or an advance of money to the council under Division 4 of Par t VII of this Act ." ;

by omitting from subsection one of section 178A the words "five hundred p o u n d s " and by insert­ ing in lieu thereof the words " t w o thousand p o u n d s ' ' ;

(c)

by omitting section three hundred and fifty- seven and the shor t head ing there to and by inser t ing in lieu thereof the following shor t heading and new sect ions:—

Cultural Welfare.

357. The council may provide, control and manage l ibrar ies and l ib ra ry

services.

357A. (1) The t rus tees of any inst i tut ion may,

subject to such conditions as a re agreed upon between the council and the t rus tees and with the approva l of the Goveimor, t r ans fe r to the council any real or personal p r o p e r t y held by them as such t rus tees .

(2) Any real or personal p r o p e r t y

t r ans fe r red in pursuance of this section shall upon such t r ans fe r be freed and discharged from

all t ru s t s there tofore affecting such p rope r ty .

(3) The council shall, subject to any
such condition, apply any real or personal

p r o p e r t y t r ans fe r red to it under th is section or

the proceeds of any sale of any such p rope r ty , or

any income ar i s ing from such p r o p e r t y or p ro ­ ceeds of sale, for any of the purposes of this P a r t .

(4) I n this section " i n s t i t u t i o n " means
mechanics ' ins t i tute , school of a r t s , l i t e ra ry
ins t i tu te , or other ins t i tu t ion for public ins t ruc­

tion or amusement .

(5) This section shall bo deemed to

have commenced upon the first day of J a n u a r y ,

one thousand nine hundred and fifty-three.

(d)

(d) (i) by inserting in subsection one of section four hundred and sixty-four after the word " regu la te" the words " the delivery, receipt or having in possession for sale o r " ;

(ii)   by omitting from the same subsection the words " , or in the abattoirs established under the Meat Industry Act, 1915";

(iii)   by inserting in subsection (1A) of the same section after the word " regula t ing" wher­ ever occurring the words " the delivery, receipt or having in possession for sale o r " ;

(iv)   by omitting from the same subsection the words "o r in the abattoirs established under the Meat Industry Act, 1915";

(v)   by inserting next after subseetkm (1A) of the same section the following new sub­ sections :—

(1B) In any proceedings under subsection one or (1A) of this section the onus of proof that the carcase or part of a carcase of an animal is the carcase or part of a carcase of an animal slaughtered in the aforesaid abattoirs shall be on the defendant.
( lc) In any proceedings under subsection one of this section proof of the fact that a person has in his possession or on any premises occupied or controlled by him where meat is offered for sale the carcase or part of the carcase of any animal shall

part thereof is intended for sale to bo used be prima facie evidence that such carcase or
as the food of man.

3 . The Cattle Slaughtering and Diseased Animals

and Meat Act, 1902-1953, is amended—

(a) (i) by inserting in subsection five of section twenty-seven after the word "prescr ibed" where firstly occurring the words "deliver, receive or have in his possession for sale

o r " ; (ii)

(ii)   by omitting from the same subsection the

words " o r in the aba t to i r s established under
the Meat I n d u s t r y Act, 1915-1952,";

(iii)   by inserting in subsection six of the same section af ter the word " r e g u l a t i n g " wher­ ever occurr ing the words " t h e delivery, receipt or having in possession for sale o r " ;

(iv)   by omitting from the same subsection the

words " o r in the aba t to i r s established under
the Meat I n d u s t r y Act, 1915-1952";
(b) by inserting at the end of the same section the following new subsections :—

(9) I n any proceedings unde r subsection five or six of this section the onus of proof t ha t any carcase or p a r t of a carcase of an animal is the carcase or p a r t of a car-case of an animal s laughtered in the s laughter-house appoin ted by the council under subsection one of this sec­ t ion as the central aba t to i r for its a rea or for t ha t pa r t , as the case may be, shall be on the defendant .

(10) In any proceedings under subsection five of this section proof of the fact tha t a person had in his possession or on any premises occupied or controlled by him where m e a t is offered for sale the carcase or p a r t of a carcase of any animal shall be p r ima facie evidence tha t
