s1 2 s4 Local Government Amendment (No. 3) No. 354, 1997 ˙ Short title 1. This regulation may be cited as the Local Government Amendment Regulation (No. 3) 1997 . ˙ Regulation amended 2. This regulation amends the Local Government Regulation 1994 . ˙ Amendment of s 23 (Declaration of exempt enterprises—Act, s 409) 3. Section 23(2), definition “local government enterprises” insert— ‘(h) one or more of the following, but only if operated by the Aurukun Shire Council within the local government area of the Shire of Aurukun, or by the Mornington Shire Council within the local government area of the Shire of Mornington— (i) general store for the sale of goods including, for example, food, clothing and petrol; (ii) post office; (iii) licensed premises under the Liquor Act 1992 .’. ˙ Insertion of new s 36BA 4. After section 36B— insert— ˙ Criteria for exemption from compliance with div 1A—Act, s 721 36BA. The criteria the Minister must consider before exempting a local government from complying with this division are— (a) the local government should have fewer than 40 employees; and (b) the likely benefits to the local government of adopting and implementing an EEO management plan under this division are outweighed by the likely financial and administrative costs to the local government of adopting and implementing the plan.’.
