2 Local Government Amendment (No. 1) No. 41, 2000 ˙ Short title 1. This regulation may be cited as the Local Government Amendment Regulation (No. 1) 2000 . ˙ Regulation amended 2. This regulation amends the Local Government Regulation 1994 . ˙ Insertion of new s 3A 3. After section 3— insert— ˙ ‘ Meaning of “State interest”—Act, s 3 ‘ 3A. For section 3 of the Act, definition “State interest” , paragraph (c), the distribution of how-to-vote cards is a State interest.’. ˙ Insertion of new s 12A 4. Part 3, after section 12— insert— ˙ ‘ Overruling particular local laws—Act, s 163 ‘ 12A.(1) For protecting State interests, it is declared that the following provisions cease to have effect to the extent they deal with the distribution of how-to-vote cards— (a) Local Law No. 2 (Council Facilities and Other Public Places), section 10, 1 made by the Caloundra City Council; (b) Local Law No. 5 (Council Facilities), section 10, 2 made by the Beaudesert Shire Council. ‘ (2) In this section— “election” means— 1 Section 10 (Distribution of an election publication) 2 Section 10 (Distribution of an election publication)
3 Local Government Amendment (No. 1) No. 41, 2000 (a) an election of a councillor or councillors of a local government; or (b) an election of a member or members of the Legislative Assembly. “how-to-vote card” means a card, handbill or pamphlet that— (a) is or includes— (i) a representation of a ballot paper or part of a ballot paper; or (ii) something apparently intended to represent a ballot paper or part of a ballot paper; or (b) lists the names of any or all of the candidates for an election with a number indicating an order of voting preference against the names of any or all of the candidates; or (c) otherwise directs or encourages the casting of preference votes, other than first preference votes, in a particular way.’. ˙ Amendment of sch 2 (Dictionary) 5.
