s1 2 s3 Local Government Amendment (No. 1) No. 158, 1997 ˙ Short title 1. This regulation may be cited as the Local Government Amendment Regulation (No. 1) 1997 . ˙ Regulation amended 2. This regulation amends the Local Government Regulation 1994 . ˙ Insertion of new pt 7B 3. After section 25A— insert— PART 7B—ANTI-COMPETITIVE PROVISIONS FOR EXISTING LOCAL LAWS AND LOCAL LAW POLICIES ˙ Definition for pt 7B 25B. In this part— “guidelines” means the document called ‘National Competition Policy Guidelines to Assist Local Governments Identify Possible Anti-competitive Provisions in Existing Local Laws and Existing Local Law Policies’ issued by the department. 1 ˙ Anti-competitive provisions for ch 15, pt 1, div 3A of Act 25C. For the definition “anti-competitive provision” in chapter 15, part 1, division 3A of the Act, the following provisions of an existing local law or existing local law policy are treated as creating barriers to entry to a market or barriers to competition within a market— (a) for a model local law made by a local government—a provision of the law the local government considers, under section 5.2.2 of the guidelines, as being within the criteria applied under the 1 Copies of the guidelines may be inspected at the State office of the department.
s3 3 s3 Local Government Amendment (No. 1) No. 158, 1997 section; or (b) for another local law, or a local law policy, made by a local government—a provision of the law or policy that— (i) is not excluded by the local government under section 5.1.1 or 5.1.2 of the guidelines; and (ii) is identified under section 5.1.3 of the guidelines as being within the criteria applied under the section. ˙ Identification of possible anti-competitive provisions—Act, ch 15, pt 1, div 3A 25D. To the extent it is reasonably practicable, reviews by local governments of their existing local laws and existing local law policies to identify possible anti-competitive provisions of the laws and policies must be carried out under the guidelines. ˙ Information to be given to Minister—Act, ch 15, pt 1, div 3A 25E. To the extent it is reasonably practicable, local governments must, for the identification of anti-competitive provisions of existing local laws and existing local law policies, give to the Minister the information stated in the guidelines at the relevant times stated in the guidelines.’.
