Local Government (Amendment) Act 2005

[Assented to 27 July 2005]

The Parliament of Victoria enacts as follows:

1.Purpose

The purpose of this Act is to amend the Local Government Act 1989 with respect to the appointment of Chief Executive Officers by Councils.

2.Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3.Varying contract of Chief Executive Officer

(1)In section 94(7)(b) of the Local Government Act 1989, for "readvertised)." substitute "readvertised); or".

(2)After section 94(7)(b) of the Local Government Act 1989 insert

"(c)before a general election for a term that continues after the general election and the contract of employment was entered into following a variation made to the Chief Executive Officer's then current contract of employment that reduced its term.".
