No. 12, before or after the passing of *" The Local Government Acts Amendment Act of 1950," of which any authority or body engaged in supplying gas in any Area or a particular Area, as the case requires, or part of the Area is the owner, user, or occupier; and (b) Without limiting the generality of the powers and functions of any Local Authority, it is hereby declared that each and every Local Authority has and possesses and may exercise and perform express powers and authorities (including the power to make by-laws) in relation to buildings so deemed to be included in any reference as aforesaid and to the use and occupation of such buildings and to other matters with respect to such buildings as if such buildings were not owned, used, or occupied by an authority or body engaged in supplying gas in its Area or part of its Area.." 15 N G o E . [ASSENTED TO 30TH MARCH, 1951.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :-. P~ ~ ~ I~ AiY. PART I.-PRELIMINARY. Short title. 1. This Act may be cited as "The Local Government Acts and Another Act Amendment Act of 1951." Parts of Act. 2. This Part n. of this Act shall be read as one Construction with *" The Local Government Acts, 1936 to 1950," (in ~ ~ : art II. this Part n. referred to as the Principal Act) and that c?ilective Act and this Part n. may be collectively cited as " The tIt e. Local Government Acts, 1936 to 1951." 4. The following additional proviso is added to Amendment paragraph ( 1 .. 1. ) 0 f subsectI.On e1.ght 0 f sect'IOn seven ofOfs. 7(8) (ii). the Principal Act, namely :- "Provided further that in respect of the triennial election to be held in the year one thousand nine hundred and fifty-two the Governor in Council may, if he deems it necessary by reason of His Majesty's visit to Australia in that year, change, by Proclamation published in the Gazette, the day prescribed by this subsection for the holding of that triennial election to some other day, being a Saturday, when in such event such triennial election shall be held on the day specified in such Proclamation." 5. Subsection one of section twenty-one of the Amendment Principal Act (being that part of the said section of s. 21 (1). twenty-one numbered "(I)" ) is amended by repealing the fourth paragraph thereof, (being the paragraph commencing with the words" No general rate ") and by inserting, in lieu of that repealed paragraph, the following paragraph, namely:- " Except as hereinafter provided in this subsection (1), the amount of the general rate made and levied in anyone year shall not exceed- (a) In the case of any and every Area where that general rate shall be made and levied on the rateable value of land as determined by a valuation under and within the meaning of "tThe Valuation of Land Acts, 1944 to 1950" made by the Valuer-General,-one shilling and sixpence in the pound of that rateable value; and (b) In any and every other case-two shillings and sixpence in the pound of the rateable value." * 1 G. 6 No. 1 and amending Acts. t 8 G. 6 No. 3 and amending Acts.

Subsection fifteen of section thirty-nine of the Amendment Principal Act is amended by adding thereto the of s. 39 (15). following paragraph, namely:- "In and for the purposes of this subsection Local Authority includes Brisbane City Council and, in relation to Brisbane City Council, references to "this Act," "Area," and "by-laws," include respectively *" The City of Brisbane Acts, 1924 to 1950," the Area of the City of Brisbane and ordinances." Brisbane City Council, under *" The City ofBrisbane Acts, 1924 to 1950 ") in respect of any land for the payment of which rate any of the following persons is or may be or become liable, that is to say:- (a) A member of His Majesty's Naval, Military or Air Forces enlisted or appointed for active service anywhere with any of those forces or with the forces of the United Nations in Korea or elsewhere if, but only if, the rate in question shall have been made and levied in respect of the whole or some part of the period of time on and from the date when that member was enlisted or appointed for service as aforesaid and thereafter until a date twelve months after he has completed that service; (b) An incapacitated returned member of His Majesty's Naval, Military or Air Forces enlisted or appointed for active service anywhere with any of those forces or with the forces of the United Nations in Korea or elsewhere; (c) A widow whose deceased husband was at his death a member or a discharged member ofHis Majesty's Naval, Military or Air Forces enlisted or appointed for active service anywhere with any of those forces or with the forces of the United Nations in Korea or elsewhere if, but only if, the death of her husband resulted from, or from causes aggravated by, that service; or * 15 G. 5 No. 32 and amending Acts. t 1 G. 6 No. 1 and amending Acts.

A~ ~ ~ ~ ~ : ~ TS LOCAL - GoVERNMENT (d) A widowed mother of an unmarried son who 1936~ ~Tr950." is deceased and who was at his death a member or a discharged member of His Majesty's Naval, Military or Air Forces enlisted or appointed for active service anywhere with any of those forces or with the forces of the United Nations in Korea or elsewhere if, but only if, the death of that son resulted fro~ , or from causes aggravated by, that servICe. (2.) This section shall apply in respect of enlistments and appointments, and periods of time on and after enlistments and appointments, as herein specified before the passing of this Act as well as to such enlistments and appointments on or after the passing of this Act. (3.) This section shall also apply to any female member of, or of any service forming part of, His Majesty's Naval, Military or Air Forces enlisted or appointed for active service anywhere with any of those forces or with the forces of the United Nations in Korea or elsewhere, including service as medical practitioner or nurse or masseuse or otherwise. (4.) A Local Authority may, by resolution or by-law (or, in the case of Brisbane City Council, ordinance) determine generally or in respect of specified cases or any specified class of cases, terms and conditions upon and subject to which it will remit and discharge wholly or in part any rate which it is empowered by this section to so remit and discharge. This Act shall be read and construed with *" The Local Government Acts, 1936 to 1949," and, in relation to Brisbane City Council, t" The City of Brisbane Acts, 1924 to 1949." Meaning of terms. 2. In this Act-.
