[ASSENTED TO 28TH JANUARY, 1943.] B E it enacted by the King's Most Excellent Majesty,. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assemb~ed,. and by the authority of the same, as follows : - PART 1.- PRELIlIlNARY. PART I.-PRELIMINARY. Short title 1 This Act may be cited as "The Local :ns d truction. Govern ment Acts and Another Act Amendment Act of 1943." Parts of Act. 2. This Act is divided into Parts, as follows : - PART I.-PRELIMINARY; PART 11. - AMENDMENTS OF "THE LOCAL GOVERNMENT ACTS, 1936 TO 1942" ; PART III.-AMENDMENTS OF "THE CITY OF BRISBANE ACTS, 1924 TO 1940." The Principal Act and this Act may collectively title. be cited as " The Local Government Acts, 1936 to 1943." Amendment 4. Paragraph (ii.) of subsection eight of section of s. 7. seven of the Principal Act is repealed, and the following paragraph is inserted in lieu thereof, as follows : - "(ii.) An election of the chairman and members shall be held on Saturday, the first day of May, one thousand nine hundred and forty-three, and such electJOn shall for all purposes of this Act be deemed to be the triennial election next succeeding the triennial election held in April, one thousand nine hundred and thirty-nine. * 1 G. 6 No. 1 and amending Acts. " next succeeding the election held pursuant to this paragraph on Saturday, the first day of May, one thousand nine hundred and forty-three, shall be held on any Saturday in April, one thousand nine hundred and forty-six as the returning officer appoints, and thereafter such election shall be held on any Saturday in April in every third year as the returning officer appoints." 5. The Third Schedule to the Principal Act is Amendment amended as follows :- ~ ~ hedule (i.) In the heading after the words" Third Schedule" Ill. . the figures and brackets " (s. 24) " are repealed and the CaptlOn. following are inserted in lieu thereof, namely "[s. 7 (8) (iv.)J." (ii.) Subdivision I of the said Schedule is amended Subdivision as follows :_ I. (a) The proviso to rule twenty-four of the said ,.. 24. subdivision is repealed. (b) A new rule 24A is inserted after rule twenty-four f. 24A. in the said subdivision, as follows :- "[24A.J (1.) The validity of any form prescribed under this Caption Act before the passing of "The Local Government Acts Amendment ~ ot trd t Act of 1943 " or any subsequent Act amending this Act shall not be ~~ : :cri~ e~ prejudiced by reason only of the fact that the collective title of this form. Act as cited in the caption to such form is changed by such amending Act. (2.) All supplies of such forms printed prior to the passing of "The lfical Government Acts Amendment Act of 1943" or, as the case may be, any such subsequent am.ending Act may, subject to the provisions of this Act in force for the time being be used and applied for the respective purposes for which they were prescribed notwithstanding any change in the collective title of this Act m.ade subsequent to the date upon which such supplies were printed. (3.) In printing supplies of any such forms subsequent to the passing of " The Local Government Acts Amendment Act of 1943 " or, as the case may be, any such subsequent amending Act the caption thereof shall be changed in order to ensure that the collective title for the time being of this Act is recited therein." n. (iii.) Subdivision of the said Schedule is amended Subdivision as follows :_ Il. (a) The form in sub-rule one of rule twenty-nine r. 29. is amended by repealing the second paragraph thereof, being all words from and including the words " In the case of" to and including the words "in the first instance."

(b) The proviso to sub-rule one of rule thirty-nine r.39. is repealed : In paragraph (b) of the second proviso to sub-rule thirty~ nine the words" and subject to the provisions relating to contingent voting" and the words "in the first instance " are repealed. Subdivision (iv.) Subdivision Ill. of the said Schedule is Ill. amended as follows : - The form of ballot-paper in rule fifty-nine IS amended by repealing therein all words from and in- cluding the words " In the case of" to and including the words " in the first instance." Subdivision (v.) Subdivision IV. of the said Schedule, being IV. rules seventy-one to seventy-seven both inclusive, is repealed. PART 111.- AJlBNDJIBN'rS 01' "THE CITY OP PART III.-AMENDMENTS OF "THE CrrY OF BRISBANE BRf~ E 1924 TO 1940." ACTS, 1924 TO 1940." ConstructiOlJ 6. (1.) Section sixteen of the Principal Act is amended as follows : - (i.) In subsection one after the words" Anzac Day" the words "or the Saturday next following Good Friday" are inserted. (ii.) The following new paragraph is added to the said subsection one, namely:- "The triennial election to be holden in the year one thousand nine hundred and forty-three of the Mayor and Aldermen shall be held on Saturday, the first day of May, one thousand nine hundred and forty-three."
