Local Government Acts Amendment Act of 1964
692 Q11crztshtn ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 61 of 1964 An Act to Amend "The Local Government Acts, 1936 to 1963 ," in certain particulars [ASSENTED TO 22ND DECEMBER, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Local Government Acts Amendment Act of 1964." (2) Principal Act. " The Local Government Acts, 1936 to 1963," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Local Government Acts, 1936 to 1964."
Local Government Acts Amendment Act of 1964, No. 61 693 2. Amendment of s. 18 (1). Subsection (1) of section eighteen of the Principal Act is amended by adding the following paragraphs:- "A Local Authority may by resolution appoint any place within the Area as the place whereat it will meet at the time specified in the resolution and may meet at such place accordingly. Save a meeting at a place other than its public office so appointed, meetings of the Local Authority shall be held at its public office." 3. Amendment of s. 21 (9). Subsection (9) of section twenty-one of the Principal Act is amended by inserting after the words " fix by by-law " the words " or in each year fix by resolution ". 4. Amendment of s. 22 . Section twenty-two of the Principal Act is amended by adding the following paragraph:- " Notwithstanding the provisions of " The Land Acts, 1962 to 1963," a Local Authority shall have and it is hereby declared always had power to borrow moneys under this section for the purpose of enabling it to effect permanent improvements on land granted to it in trust or reserved and set apart and placed under its control as trustee pursuant to the provisions of Part XI of those Acts, or for the purpose of adding to or maintaining permanent improvements already effected on such land, or for such other purposes as may be from time to time approved by the Governor in Council, either generally or in any particular case." 5. Amendment of s. 32 (7). Subsection (7) of section thirty-two of the Principal Act is amended by adding the following paragraph:- " The Local Authority may aid the National Trust of Queensland constituted under " The National Trust of Queensland Acts, 1963 to 1964," and may, pursuant to those Acts, become a member of the National Trust of Queensland." 6. Amendment of s. 42B . Section 42B of the Principal Act is amended by omitting subsection (2) and inserting in its stead the following subsection:- " (2) Any animal found at large or depasturing on any road or on any reserve or other land under the control of a Local Authority or being driven along or on to any road or any such reserve or other land for the purpose of depasturing may be seized and taken possession of by such Local Authority: Provided that this subsection shall not apply to- (a) Travelling stock being depastured or being driven for the purpose of depasturing within the limits and in accordance with the conditions imposed by the laws in force for the time being related to travelling stock; or (b) Animals being depastured under license or being driven for the purpose of so depasturing within the limits and in accordance with the conditions imposed by the laws in force for the time being relating to the depasturing of animals on roads and reserves; or
694 Local Government Acts Amendment Act of 1964, No. 61 (c) Animals found at large or depasturing on part of a road or being driven for the purpose of depasturing on part of a road where the proprietor of such animals has been authorized in accordance with the laws in force for the time being to fence that part of the road in with land occupied by him." 7. Amendment of s. 52 (10). Subsection (10) of section fifty-two of the Principal Act is amended by, in subparagraph (a) of paragraph (i), omitting the words " one month " and inserting in their stead the words " three months ".
