(1.) This Act may be cited as The Local Shorl title- Government Acts Amendment Act of 1958.” (2.) *“ The Local Government Acts, 1936 to 1958,” ^ncipal are in this Act referred to as the Principal Act.- °' (3.) The Principal Act and this Act may be Collective collectively cited as The Local Government Acts, 1936t,{ e' to 1958.”2 2. Section four of the Principal Act is amended Amendment by inserting, after subsection nine thereof, the following 0 s- ' subsection:— “(9 a . ) If vacancies occur (or have occurred prior to the enactment of this subsection) in the offices of members of a council so as to prevent a quorum of members from being obtained, the Governor in Council may, by Order in Council, appoint some person to carry on for such period as may be specified in the Order in Council such of the functions of the council and to exercise, perform and undertake such of its powers, duties, authorities and responsibilities as are specified in the Order in Council; and for the purposes of carrying on, exercising, performing and undertaking the functions, powers, duties, authorities and responsibilities specified in the Order in Council the person thereby appointed shall be deemed to be the Local Authority. * 1 G. 6 No. 1 and amending Acts.

The Governor in Council may by the same or a subsequent Order in Council direct that an election to fill the vacancies shall be held by and before such returning officer at such time as the Governor in Council may appoint; and, if necessary, a fresh voters’ roll shall be compiled in accordance with this Act for such election by such person and in such manner as the Governor in Council may direct and such roll, when compiled and certified to be correct by such person, shall be conclusive evidence of the right to vote at, and shall not be questioned at or in connection with, such election. This subsection shall apply subject to subsection nine of this section and so as not to limit or prejudice howsoever the powers conferred upon the Governor in Council by the said subsection nine.” Amendments of s. 7 (10). 3. Subsection ten of section seven of the Principal Act is amended— (a) By repealing the fourth subparagraph (being the subparagraph commencing with the words “ If vacancies occur at any time ”) of paragraph (i.) thereof; and (6) By repealing, in the fifth and last subparagraph of paragraph (i.) thereof, the words “ under this subsection ”. Ratification. 4 . Whereas by reason of the occurrence of vacancies preventing a quorum of members of the Council of the Shire of Peak Downs from being obtained arrangements were made on or about the fifteenth day of August, 1958, for the Clerk of the said Council to draw cheques on the accounts of the said Council with the National Bank of Australasia Limited for the payment of the salaries and wages of its officers and other employees pending . legislative provision for the administration for the time being of the functions of the said Council:

And whereas it is desirable that Parliament should approve those arrangements and that they should continue for the time being: Now therefore the arrangements referred to in the Preamble to this section are hereby approved and shall continue to have and be of force and effect until the Minister terminates the same by notice in writing to the aforesaid Bank. 475 An Act to Amend “ The Local Government Acts, 7 N o .IZ54IL 1936 to 1958,” in certain particulars. (1.) This Act may be cited as The Local Shorfc titl6. Government Acts Amendment Act of 1958 (No.- 2 ).” (2.) *“ The Local Government Acts, 1936 to 1958,” ^“oipal are in this Act referred to as the Principal Act. (3.) The Principal Act and this Act may be^eotiv* collectively cited as The Local Government Acts, 1936 to 1958.”2 2. Subsection two of section four of the Principal oAfms. en4d(m2)e.nt Act is amended by adding to subparagraph (i.) of the second paragraph thereof the following paragraphs:— (h) Regulating and controlling the keeping of accounts and records required under section 19 b of this Act, and ensuring that the same will, in relation to contracts to which that * 1 G. 6 No. 1 and amending Acts.
