No. 35 of 1969.

AN ACT to amend section three hundred and

seventy-four of the Local Government Act,

1960-1968.

[Assented to 19th May, 1969.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

Short title

1. (1) This Act may be cited as the Local and citation.

Government Act Amendment Act, 1969.

1968, is referred to as the principal Act.

amended. 2. Subsection (2) of section 374 of the principal

Act is amended

(a)	by substituting for the subsection designa- tion, "(2)" in line one, the passage, "(2) (a)"; and
(b)	by adding at the end of the subsection the following paragraph

(b) For the purposes of exercising his powers under paragraph (a) of this sub- section, the Minister may, where in his opinion the circumstances of a particular case warrant his so doing, order that any provision of a by-law made by a Council under this Part or of a uniform general by-law in force under this Part does not apply in that particular case or shall apply as modified by the order in that particular case and thereupon that order has effect according to its tenor, notwith- standing any provision to the contrary in, or in force under, this Act. .
