LOCAL GOVERNMENT ACT 1993—REGULATION

(Relating to the Ultimo/Pyrmont Light Rail Transit)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Local Government Act 1993, has been pleased to make the Regulation set forth hereunder.

The Local Government (Approvals) Regulation 1993 is amended by

inserting after clause 6A the following clause:

Exclusion of Ultimo/Pyrmont Light Rail Transit Project

6C. Pursuant to sections 69 and 748 of the Local Government Act 1993, the Sydney Light Rail Company Limited, the Pyrmont Light Rail Company Pty Limited and the Light Rail Construction Company Pty Limited, or any of them, may carry out the following activities without the approval of the Council of the City of Sydney on the land subject to the Land Agreement executed by the Department of Transport, State Rail Authority of New South Wales, Pyrmont Light Rail Company Pty Limited and Light Rail Construction Company Pty Limited dated 29 November 1995 and any associated land:

(a) the construction of a light rail system (and any buildings associated with the system) including:

• structures (such as concrete slabs and ballast) for the laying or for the supporting of rail track

• the laying or the supporting of rail track

• the provision of power supply systems (such as poles for suspending wires above the rail track, the suspension of wires and the erection of substations)

• signalling systems

• stations and their equipment and infrastructure

• other infrastructure associated with the light rail system

• maintenance works and facilities;

(b)	the demolition of any building for the purposes of the construction of the light rail system;
(c)	the doing of anything that is incidental to the erection or demolition of a building for the purposes of the light rail system.

EXPLANATORY NOTE

The object of this Regulation is to enable the provision of the Ultimo/Pyrmont Light

Rail Transit without the necessity for the approval of the Council of the City of Sydney

under section 68 of the Local Government Act 1993.
