LOCAL GOVERNMENT ACT 1993—REGULATION
(Relating to penalty notice offences)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Local Government Act 1993, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 July 1994.
Amendments
2. Schedule 1 to the Local Government (Penalty Notice Offences)
Regulation 1993 is amended:
(a)
by inserting in appropriate order the following matter: Section 628 (2)—fail to comply with an order
that is an order in the terms of order No. 27 in the Table to section 124 (To remove an object or matter from a public place or prevent any object or matter being deposited there) ......

(b)
by omitting from Column l in the matter relating to section 629 (2) the words “public land” and by inserting instead the words “a public place”;
(c)
by omitting from Column 1 in the matter relating to section 632 (1) the words “on public land or in a public bathing place under the control of a council” and by inserting instead the words “in a public place within the area of a council”.

EXPLANATORY NOTE
The objects of this Regulation are:
| (a) | to make the offence of failure to comply with a council order requiring a person to remove an object or matter from a public place or prevent any object or matter being deposited there an offence which may be dealt with by penalty notice; and |
| (b) | to make minor changes to the description of certain penalty notice offences consequential on the amendment of those offences by the Local Government Legislation (Miscellaneous Amendments) Act 1994. |
This Regulation is made under the Local Government Act 1993, in particular section 679 (Penalty notices for certain offences) and section 748 (the general regulation making power).
