LOCAL GOVERNMENT ACT 1993—REGULATION
(Relating to moveable dwellings, manufactured home estates, caravan parks and
camping grounds)

in pursuance of the Local Government Act 1993, has been pleased tomake the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 September 1995.
Amendment
2. The Local Government (Approvals) Regulation 1993 is amended:
(a) by omitting from clause 4 (1) the definition of “registrable
moveable dwelling” ; (b)
by inserting after clause 5 the following clause: Exclusion of certain matters
5A. This Regulation does not apply to:
(a)
the installation of manufactured homes, moveable dwellings or associated structures on land; or
(b)
the operation of manufactured home estates, caravan parks or camping grounds.
NOTE: The operation of manufactured home estates, and the installation of
manufactured homes in manufactured home estates, are governed by the Local Government (Manufactured Home Estates and Manufactured Homes) Regulation 1995. The operation of caravan parks and camping grounds, and the installation of moveable dwellings (including manufactured homes) both in caravan parks and camping grounds and elsewhere, are governed by the Local Government (Caravan Parks, Camping Grounds and Moveable Dwellings) Regulation 1995.

| (c) | by omitting from the heading to Part 2 the words TEMPORARY STRUCTURES OR MOVEABLE DWELLINGS” and by inserting instead the words “AND TEMPORARY STRUCTURES”; |
(d) by omitting clause 9 (2);
(e) by omitting clauses 14, 15, 42 and 66;
(f) by omitting clause 70 (a)—(e);
(g) by omitting Divisions 2 and 3 of Part 6 ;
(h) by omitting clause 149.
EXPLANATORY NOTE
The object of this Regulation is to repeal certain provisions of the Local Government
(Approvals) Regulation 1993 that relate to:
(a) the installation of moveable dwellings and associated structures on land; and
(b) the operation of manufactured home estates, caravan parks and camping grounds.
These matters are to be governed by the Local Government (Manufactured Home Estates and Manufactured Homes) Regulation 1995 and the Local Government (Caravan Parks, Camping Grounds and Moveable Dwellings) Regulation 1995.
This Regulation is made under the Local Government Act 1993. including section
748 (the general regulation making power) and various other sections.
