Amendment (Enforcement of Parking

and Related Offences) Regulation 2002

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note

The object of this Regulation is to declare that certain parking and related offences for which penalty notices may be served by council officers under the Road Transport (General) Act 1999 are parking and related offences for the purposes of section 694 of the Local Government Act 1993. Under section 694, revenue that a council derives from fines for these offences may be the subject of a revenue- sharing agreement with the State.

This Regulation is made in connection with the commencement of the Local Government Amendment (Enforcement of Parking and Related Offences) Act 2002. This Regulation is made under the Local Government Act 1993, including section 748 (the general power to make regulations) and section 694.

1     Name of Regulation

This Regulation is the Local Government (General) Amendment

(Enforcement of Parking and Related Offences) Regulation 2002.

2 Commencement

This Regulation commences on 22 July 2002.

3 Amendment of Local Government (General) Regulation 1999

The Local Government (General) Regulation 1999 is amended as set out in Schedule 1.

Clause 43B

Insert after clause 43A:

43B Parking and related offences for purposes of section 694

Any offence for which a penalty notice may for the time being be served under section 15 of the Road Transport (General) Act 1999 by a Class 12 officer referred to in Schedule 1 to the Road Transport (General) (Penalty Notice Offences) Regulation 2002 is declared to be a parking or related offence for the purposes of section 694 of the Act.

Note. The Road Transport (General) (Penalty Notice Offences) Regulation 2002 defines the expression Class 12 officer and lists the offences for which a penalty notice may be served by such an officer. By operation of this clause, any offence in that list is a parking or related offence for the purposes of section 694 of the Act.
