His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note

Local Government Act 1993
Section 46 (1) of the enables leases, licences or other purposes of section 46 (1) (b) (iii) of the Act the use of any road or fire trail in existence on the commencement of this Regulation that is located on community land for any of the following purposes:
estates to be granted in respect of community land for certain purposes.

(a) to transport building materials and equipment required in relation to building work that is to be, or is being, carried out on land adjoining the community land,
(b) to remove waste that is consequential on such work.

The new provision will replace clause 24 (3) of the principal Regulation, which will expire at the end of 31 December 2000.

1     Name of Regulation

This Regulation is the Local Government (General) Amendment

(Community Land) Regulation 2000.

2 Commencement

This Regulation commences on 1 January 2001.

3 Amendment of Local Government (General) Regulation 1999

The Local Government (General) Regulation 1999 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

(Clause 3)

Clause 24 Leases, licences and other estates in respect of community land

Omit clause 24 (3). Insert instead:

(3) For the purposes of section 46 (1) (b) (iii) of the Act, the use of
any existing road or fire trail on community land:

(a)

to transport building materials and equipment required in relation to building work that is to be, or is being, carried out on land adjoining the community land, or

(b) to remove waste that is consequential on such work,
is prescribed as a short-term, casual purpose.

(4) In this clause:

existing road or fire trail means a road or a fire trail that was in existence on the date on which the Local Government (General) Amendment (Community Land) Regulation 2000 commenced.
