1997, which came into force on l January 1999, amended section 303 of the local Government Act 1993. The amended section 303 allows a person dissatisfied with a decision of the Electoral Commissioner or a general manager relating to a claim for, or objection to, the inclusion of a name or other particulars on an electoral roll to apply to the Administrative Decisions Tribunal for a review of that decision, instead of requiring the dissatisfied person to appeal to the Local Court (as was previously the case).
The object of this Regulation is to repeal and amend provisions of the Local Government (Elections) Regulation 1998 that relate to appeals to the Local Court, namely:
(a) clause 14—which deals with the method of appeal to the Local Court, and (b) clause 15-which deals with the supply of forms by the Electoral Commissioner and general managers, including forms relating to appeals to the Local Court. This Regulation is made under the Local Government Act 1993, including section 748 (the general regulation-making power).
