His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note

The objects of this Regulation are:

to require a council to be satisfied that a current log book and contract
of insurance or indemnity exist for an amusement device, before
approving an application to install or operate the device (see Schedule

to provide that a council’s approval of an application to install or
operate an amusement device is conditional on compliance with all
registration conditions and other relevant requirements under the

1 [1]), and installation of the device (see Schedule 1 [2]), and

$10,000,000 in respect of each accident involving death or personal
to increase the minimum amount of cover required under a contract of insurance or indemnity for an amusement device from $5,000,000 to
injury (see Schedule 1 [3]).

This Regulation is made under the Local Government Act 1993, including section 748 (the general regulation-making power) and Schedule 6 (8) (which specifies matters about which regulations may be made).

1 Name of Regulation

This Regulation is the Local Government (Approvals)

Amendment (Amusement Devices) Regulation 1998.

2 Commencement

This Regulation commences on 1 February 1998.

3 Amendment of Local Government (Approvals) Regulation 1993

The Local Government (Approvals) Regulation 1993 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 3 )

[1]        Clause 142 Standards to be met for approval

Insert after clause 142 (c):

, and

(d)

that there exists for the device a current log book within the meaning of the Construction Safety Regulations 1950, and

(e)

that there is in force a contract of insurance or indemnity for the device that complies with clause 144.

Clause 143 Compliance with standards
Omit clause 143 (c). Insert instead:
(c) all conditions subject to which the device is registered under the Construction Safety Regulations 1950 and all other relevant requirements of those Regulations are complied with,
(d) the device is installed (including erected) and operated in a safe manner.

[3]        Clause 144 Insurance

Omit “$5,000,000” from clause 144. Insert instead ‘‘$10,000,000”.
