LOCAL GOVERNMENT ACT 1919—ORDINANCE

(Relating to the roadside sale of motor vehicles)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Local Government Act 1919, has been pleased to make the Ordinance set forth hereunder.

Commencement

1. This Ordinance commences on 15 February 1991.

Amendment of Ordinance No. 38

2. Ordinance No. 30 under the Local Government Act 1919 is

amended by inserting after clause 12A the following clause:

Offering motor vehicles for sale on certain public roads

12B. (1) A person must not park a motor vehicle on a public road referred to in the Table to this clause for the purpose of the motor vehicle’s being offered for sale to any other person on that road.

(2) A person must not, while on a public road referred to in the Table to this clause, offer for sale, or otherwise participate in the conduct of negotiations concerning the sale or proposed sale of, any motor vehicle that is parked on that road.

EXPLANATORY NOTE

The object of this Ordinance is to amend Ordinance No. 30 under the Local

Government Act 1919 so as:

(a) to prohibit a person from parking a motor vehicle in Victoria Street, Kings Cross, for the purpose of offering the vehicle for sale to any other person on that street; and
(b) to prohibit a person, while on Victoria Street, Kings Cross, from offering for sale a motor vehicle that is parked in that street.

Any motor vehicle that is illegally parked will, under Regulation 58A of the Motor Traffic Regulations 1935, be liable to be towed away by the police or by local council officers.
