LOCAL GOVERNMENT ACT 1919 - ORDINANCE

(Relating to the rate of preference applicable to the

purchase of Australian goods over foreign goods by councils)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Local Government Act 1919, has been pleased to make the Ordinance set forth hereunder.

Commencement

1. This Ordinance commences on 22nd day of February, 1991.

Amendment

2. Ordinance No. 23 under the Local Government Act 1919 is amended by omitting clause 19 and by inserting instead the following clause:

Preference to Australian goods

19. For the purposes of section 517A of the Act, the prescribed rate of preference to be given to Commonwealth goods over foreign goods (other than New Zealand goods) is 20 percent.

EXPLANATORY NOTE

The Local Government Act 1919 provides that a percentage may be prescribed for a rate of preference to be given to Australian goods over foreign goods by councils when purchasing or obtaining goods. Such a percentage does not have to be prescribed, nor does it have to be prescribed for all goods. The regulations may prescribe different percentages in respect of foreign goods manufactured or produced in different places, at different times or in different circumstances.

Clause 19 formerly prescribed a different rate of preference for Australian goods over New Zealand goods to that for Australian goods over goods imported from other countries. The rate of preference to be given by councils to Australian goods over New Zealand goods is abolished and the rate of preference to be given by councils to Australian goods over foreign goods (other than New Zealand goods) is to remain at 20 percent.
