LOCAL GOVERNMENT ACT 1919 - ORDINANCE

(Relating to rolls of electors)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Local Government Act 1919, has been pleased to make the Ordinance set forth hereunder.

Commencement

1. This Ordinance commences on 13 July 1990.

Amendment

2. Ordinance No. 14 under the Local Government Act 1919 is amended by omitting clause 2 and by inserting instead the following clause:

Closing date of rolls

2. (1) The date prescribed for the closing of the residential roll (and therefore for the non-residential roll also) for an election within the meaning of section 63A of the Act or for a poll (whether or not the poll is taken in conjunction with such an election) is the date of the fortieth day preceding the day of the election or poll.

(2) If the Minister postpones an election under section 38 (2)
of the Act, the date prescribed for the closing of the residential roll

(and therefore for the non-residential roll also) for the election is:

(a) in the case of an election postponed before the fortieth day preceding the original day of the election - the date of the fortieth day preceding the new day appointed by the Minister for the election; or
(b) in any other case - the date of the fortieth day preceding the original day of the election.

(3) This clause as in force immediately before 13 July 1990 continues to apply to any roll for which the prescribed closing date under that clause was earlier than 13 July 1990.

EXPLANATORY NOTE

The object of this Ordinance is to amend Ordinance No. 14 under the Local

Government Act 1919 so as:

(a)

to provide that the closing date of rolls for any Council election or poll is the fortieth day preceding the election or poll (currently different closing dates apply for different types of elections and polls); and

(b)

to provide that if the Minister postpones an election before the closing date of the rolls for the election the closing date is extended to the fortieth day preceding the new date for the election but remains unchanged if the postponement occurs on or after that closing date.

Rolls closed before the commencement of the amendment will not be affected by

the amendment.
