LOCAL GOVERNMENT ACT 1919—ORDINANCE

(Relating to burials in graves)

NEW SOUTH WALES

[Published in Gazette No. 24 of 12 March 1993]

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Local Government Act 1919, has been pleased to

make the Ordinance set forth hereunder.

G. B. PEACOCKE, M.P.,

Minister for Local Government.

Commencement

1. This Ordinance commences on 15th March, 1993.

Amendment

2. Ordinance No. 68 under the Local Government Act 1919 is amended by omitting clause 6.

EXPLANATORY NOTE

Clause 6 (Restrictions upon interment) of Ordinance No. 68 under the Local Government Act 1919 had the effect of preventing the burial of a child under the age of 10 years in the same grave with the child’s parents. It also stated certain depth measurements that were to be observed when a coffin was placed in a grave and when additional coffins were placed in that grave. These provisions were at variance with clause 32 (Burial of bodies) of the Public Health Regulation 1991 which does not so restrict a child‘s burial and stipulates a different measurement
