LOCAL GOVERNMENT ACT 1919—ORDINANCE

(Relating to adjustment of cash payments as copper coins are

withdrawn from circulation)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Local Government Act 1919, has been pleased to make the Ordinance set forth hereunder.

Commencement

1. This Ordinance commences on 20 April 1992.

Amendment of Ordinance No. 26

2. Ordinance No. 26 under the Local Government Act 1919 is

amended by inserting after clause 41 the following clause:

Cash payments

41A. (1) If a person offers payment in cash of an amount payable to a council which is not a multiple of 5 cents, the council may round the amount down to the nearest multiple of 5 cents. The amount so rounded down is taken to be the amount payable to the council.

(2) This clause has effect despite any other provision of this

Ordinance.

EXPLANATORY NOTE

Because 1 and 2 cent coins are to be withdrawn from circulation, those coins

will gradually become unavailable for cash payments or for giving change.

The purpose of this Ordinance is to amend Ordinance No. 26 under the Local Government Act 1919 so as to provide for the manner in which a council is to deal with the payment in cash of an amount payable to the council which is not a multiple of 5 cents.

The amendment will enable a council to round the amount payable down to the nearest multiple of 5 cents. The rounded amount is then taken to be the amount

payable to the council.
