The Local Court (Civil Claims) Rule Committee made the following rule of court under the Local Courts (Civil Claims) Act 1970 on 14 December 1999.

Explanatory note
The object of this Rule is to replace certain references in the Local Courts (Civil Claims) Rules 1988 to the former $3,000 general limit for a court sitting in its Small Claims Division with references to the new limit of $10,000. The limit is increased from $3,000 to $10,000 by amendments made to the Local Courts (Civil Claims) Act 1970 by Schedule 6 to the Courts Legislation Amendment Act 1999.

This Rule is made under the Local Courts (Civil Claims) Act 1970, including section 84 (the general rule-making power).

1      Name of Rule

This Rule is the Local Courts (Civil Claims) Rule (General Limits)

1999.

2 Commencement

This Rule commences:

(a)	if Schedule 6 to the Courts Legislation Amendment Act 1999 commences on or before the day on which this Rule is published in the Gazette—on the day on which this Rule is published in the Gazette, or
(b)	if Schedule 6 to the Courts Legislation Amendment Act 1999 has not commenced on or before the day on which this Rule is published in the Gazette—on the day on which that Schedule commences.

3 Amendment of Local Courts (Civil Claims) Rules 1988

The Local Courts (Civil Claims) Rules 1988 are amended as set out in Schedule 1.
