AN ACT to amend the Local Courts Act, 1904-1931.

[Assented to 10th November, 1953.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Local Courts 2VitiaTieon_

Act Amendment Act, 1953.

(2) In this Act the Local Courts Act, 1904-1931, Act No. 51 of 1904 consolidated and reprinted in the appendix to the sessional volume of Acts, 1912, and further amended by Acts Nos. 21 of 1921, 35 of 1930, 31 of 1931 and 13 of 1938,

is referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Local Courts Act, 1904-1953.

amended. 2. Section thirteen of the principal Act is amended

by adding

(a)	after the section number, "13" in line one the figure "1" in brackets thus—(1);
(b)	after the word "may" in line one the words, "subject to the provisions of subsection (2) of this section";

(c) the following subsections:

(2) Where the person who is to be appointed a clerk or assistant clerk is not subject to the provisions of the Public Service Act, 1904 - 1950, he shall be appointed clerk or assistant clerk by the Minister.

(3) The Minister may during the absence or temporary incapacity of a clerk or an assistant clerk appoint a substitute to discharge the duties of the clerk or assistant clerk.

amended.	3. Section ninety-nine of the principal Act is amended by substituting for the words "one hundred" in line two the words "five hundred".

(a)	substituting for the words "one hundred" in lines two and three the words "five hundred";
(b)	substituting for the words "one hundred" in line sixteen the words "two hundred and fifty".
