LOCAL COURT (SMALL CLAIMS FEES) RULES

Rules under the Local Court Act

1Citation

These Rules may be cited as the Local Court (Small Claims Fees) Rules.

2Fees for filing

There is payable by a person instituting proceedings in the Court under the Small Claims Act seeking an order for the payment of money, the following filing fees:

Where the amount claimed is:

less than $100	–	nil
$100 or more but less than $2,000	–	$10
$2,000 or more but less than $3,000	–	$20
$3,000 or more but less than $4,000	–	$30
$4,000 or more	–	$40

3Recovery of filing fee

In a proceeding, a filing fee referred to in rule 2 is recoverable as part of the judgment whether or not the filing fee has been claimed in the statement of claim.

4Recovery of service fee

A fee for service referred to in Schedule 1 to the Local Court Rules applies to personal service of a document in a proceeding and is recoverable as part of the judgment whether or not the fee for service has been claimed in the statement of claim.
