The Local Court Rule Committee has made the following rule of court under the Local Court Act

2007.

Explanatory note

The object of this Rule is to amend the Local Court Rules 2009 to require the Chief Magistrate to appoint a fixed vacation period each year. During this period, the Court may only sit on the days and at the places, and hear the types of proceedings, that the Chief Magistrate directs.

1      Name of Rule

This Rule is the Local Court (Amendment No 8) Rule 2017.

2      Commencement

This Rule commences on the day on which it is published on the NSW legislation website.

3 Amendment of Local Court Rules 2009

Rule 8.2A

Insert after rule 8.2:

8.2A Fixed vacation
(1) The Chief Magistrate is to appoint in each year a vacation period, not
exceeding 14 days, to be known as a fixed vacation.
(2) During a fixed vacation, the Court is to sit only on the days and at the places, and for the hearing of the types of proceedings, that the Chief Magistrate directs.
