AN ACT to amend section eleven of the Local Authorities

(Reserve Funds) Act, 1942-1944.

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

short title of

1. This Act may be cited as the Local Authorities

No. 3 of 1944,

(Reserve Funds) Act Amendment Act, 1945, and shall

be read as one with the Local Authorities (Reserve Funds) Act, 1942-1944 (No. 26 of 1942 as amended by the Act No. 3 of 1944), hereinafter referred to as the prin- cipal Act.

Section eleven of the principal Act is amended by adding thereto a proviso as follows :—

Provided that this section shall not apply in any case where a local authority desires to raise a loan under its local government Act in respect of a par- ticular work or undertaking and the Governor, being satisfied that the utilisation for the purpose of the said work or undertaking of moneys then in the reserve fund established by the local authority is neither desirable nor expedient either in the interest of the local authority or of the ratepayers of the local authority, approves of the raising of such loan.
