[ASSEN'J'ED TO 20TH DECEMBER, 1905.1 B E it enacted by the King's Most Excellent Majesty~ by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same,. as follows :-. Short title and 1. This Act may be cited as " The Local Authorities- construction Act Amendment Act cif 1905," and shall be read as one of Act. with" The Local Authorities Act of 1902,"* herein referred to as the Principal Act. Amendments 2. The following amendments are hereby made in of Principal the Principal Act, and, save as hereinafter provided, the Act. Principal Act shall be read and construed as if the said amendments were contained therein at the date of the passing of this Act :- (1.) After section two hundred and forty-nine of the Principal Act, the following section is inserted :- Sales of land "[249A.J No sale of land or of any estate or interest valid .rlOtwith. therein heretofore made or purporting to have been made isrtraengdumlagriatyn. y un der t h e prOV.IsI.Ons 0 f t l lI ' S S U bd· lVI.S.lOn 0 f tbI' S Act sha 1 ' 1 be rendered invalid merely by reason of any failure to comply with any of the said provisions, or of any omission, irregularity, insufficiency, or inaccuracy in the observance of any of the said provisiuns, whether in substance or in form; ~ \lld every such sale heretofore made shall be valid and effectual for all purposes whatsoever, notwithstanding any such failure, omission, irregularity, insufficiency, or inaccuracy. No purchaser upon any such sale shall be bound to inquire whether such sale has been properly made under the said provisions or be affected by notice, either express or implied, that there has been any such failure, omission, irregularity, insufficiency, or inaccuracy as aforesaid. No action or other proceeding shall lie or be taken against any such purchaser as aforesaid, or against any [.ocal Authority or anyofficer or fund thereof, or against any State officer, or against the assurance fund established under " Tile Real Property Acts, 1b61 to 1887,"* or any fund administered or controlled by the State or any State officer, in respect of any sale of land or of any estate or interest therein heretofore made or purporting to have been made . under the provisions of this Subdivision of this Act, or by reason of any failurp to comply with any of the said pro- visions, or of any omission, irregularity, insufficiency, or inaccuracy in the observance of any of the said provisions, whether in substance or in form, on the part of any such purchaser, or any such Local Authority or officer thereof, or any such 8tate officer: Provided aIways that this section shall not be con- strued so as to afford any protection to any Local Authority, officer, or person who has been guilty of fraud or wilful default in connection with any such sale." 3. Nothing jn this Act contained shall affect or in Saving?f any wa • y pre " iud . ice any . caveat entered or action co . mmenced p p r e O n Cd~ m e g di o ng r s or notICe of actIOn gIven before the first day of October, completed. one thousand nine hundred and five, with respect to the validity of any sale of land or of any estate or interest ther{ ~ in, made or purporting to have been made under Subdivision VI. of Part XII. of the Principal Act, or render valid any transfer or conveyance of land or of any estate or interest therein, the validity whereof was at that date directly or indirectly in dispute under such caveat or action; and all such caveats and actions, whether completed 01' pending at that date, shall be of the same effect and may be continued, proceeded with, and completed as if this Act had not been passed.
