An Act to provide for the amalgamation of certain Loan Funds raised under Special Loan Acts. [23rd April, 1879.]

W H E R E A S b y t h e " L o a n A c t of 1 8 7 1 " and by every subsequent

A c t au thor iz ing the rais ing of a loan or loans for Pub l ic

W o r k s or o ther publ ic purposes it is provided t h a t all sums borrowed

or au thor ized to be applied u n d e r t he special Ac t shall be paid to t h e Colonial Treasurer and shall be by h i m placed to a separate credit to be called " The L o a n F u n d " and t h a t no par t of the money so borrowed shall on any pre tence be paid used or applied direct ly or indirect ly ei ther temporar i ly or otherwise to or for any publ ic purpose o ther t h a n t h e purposes respectively to which t h e same is by such special A c t directed to be applied A n d whereas t h e necessity for such provision does no t now exist and i t is considered expedient to repeal t he same Be it therefore enacted by the Queen ' s Mos t Exce l len t Majes ty by and with the advice and consent of t he Legis la t ive Council and Legislat ive Assembly of New South Wales in Pa r l i amen t assembled and by the au thor i ty of t he same as follows :—

1. This A c t m a y be ci ted for all purposes as the " Loans Fund

A m a l g a m a t i o n A c t of 1879 ."

2. I n t he const ruct ion and for t he purposes of th is A c t the expression " S p e c i a l A c t " means t he A c t unde r which any s u m of money has been or shall be authorized to be raised for any purpose there in expressed and the expression " Loan Service" means any purpose specified in any such special Act. '

3 . F r o m and after t he commencement of th is Ac t all sums of money borrowed under the au thor i ty of any of t he Acts specified in the Schedule here to and not a l ready applied for or towards any of the purposes to which such sums were directed to be respectively applied by such A c t m a y no twi ths tand ing a n y t h i n g to t h e cont ra ry in any such A c t contained be applied for or towards t h e purpose of any Loan Service whe the r specified in any of t h e said Acts or in any special Ac t hereafter to be passed in such m a n n e r and in such proport ions as the Governor shall by w a r r a n t under his hand addressed to t he Colonial Treasurer from t ime to t ime order and direct A n d all sums of money hereafter to be borrowed under t he au thor i ty of any special A c t may in l ike manne r b u t subject to t h e like l imita t ion

be applied to any such Loan Service as aforesaid	Provided t h a t
n o t h i n g in this section contained shall au thor ize t he	application

to any such L o a n Service of any larger sum of money t h a n is or shall be by the special A c t au thor iz ing such service expressly appropriated or set apa r t therefor.

4. Al l sums of money borrowed under t he au tho r i t y of a n y of

the Acts specified in t he said Schedule and all sums of money here­ after to be borrowed the reunder or unde r any special A c t hereafter to be passed shal l after the passing of this Ac t be carried to and form a " G e n e r a l L o a n A c c o u n t " in such m a n n e r as t he Colonial Treasurer

shall direct Provided t h a t no port ion of t h e money included in such

General L o a n A c c o u n t shall be applied or used for a n y purpose other

t h a n services author ized to be provided for by Loans .
