An Act to authorize the raising1 of a Loan for the Public Service of the Colony and for other purposes. [20th December, 1890.]
1. I t shall be lawful for the Governor, with the advice of the Executive Council, to raise hy the sale of Debentures or the issue of Inscribed Stock, secured upon the Consolidated Revenue Eund of the Colony, and hearing interest at a rate not exceeding four per centum per annum, such several sums of money not exceeding in the whole the sum of Seven million and twentv-one thousand seven hundred and WH E R E A S it is expedient to authorize the Governor, with the the Public Service of the Colony, certain sums of money amounting advice of the Executive Council, to raise by way of Loan for
in the whole to Seven million and twenty-one thousand seven hundred and fifty-seven pounds for the several purposes hereinafter specified : Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

2. All sums borrowed under this Act shall he paid to the Colonial Treasurer and shall he by him placed to a separate credit, to be called " The General Loan Account."
3. In addition to any of the appropriations hereby made and
for the carrying out of the respective works and for the several purposes hereinbefore specified the unexpended balances of all sums raised by way of loan under all Acts authorizing the raising of loans prior to the Act thirty-fifth Victoria number five, and now standing in the books of the Treasury at the credit of an account known as the "Old Loans Account," amounting in the whole to the sum of one hundred and thirty-two thousand three hundred and twenty-six pounds and fourpence, shall be applied towards meeting the services authorized by this Act, and the same shall be transferred to the credit of the General Loan Lund accordingly.
4. All Stock or Debentures, created or issued for the purposes of this Act, shall be " Government Stock" and a "Government Security" within the meaning of the Act twenty-sixth Victoria number twelve (the "Trust Property Act of 1S62"), and of the Act seventeen Victoria number twenty-six, or any Act in force for the time being relating to Friendly Societies, and all corporations, companies, or co-partnerships, and all trustees, executors, and administrators, whether incorporated, established, or appointed before or after the passing of this Act, not expressly forbidden to invest their funds in the purchase of Government Stock or securities by their charter, Act of Incorporation, deed of settlement, or of partnership, trust, deed, settlement, testamentary or
other instrument whatsoever respectively, are hereby authorized and
empowered to invest such funds in the purchase of and to hold stock created or debentures issued under or for the purposes of this Act without incurring or committing any breach of trust or of any condition, restriction, or provision contained in any such Act, charter, or other instrument whatsoever as aforesaid.
5. The Governor, with the advice of the Executive Council, may make regulations, not being inconsistent with the; provisions of the " Inscribed Stock Act of 1883," for carrying tins Act into effect. And such regulations shall be published in the Government Gazette and
laid before Parliament, within fourteen days after the publication
thereof if Parliament be then sitting, and if Parl iament be not sitting
then within fourteen days after the next Session thereof.
6. The said Treasurer shall issue and pay the said several sums
for the purposes hereinbefore mentioned, in such manner and in such
proportions as the Governor, by any warrant or order in writing under
his hand, and directed to the said Treasurer, shall from time to time
order and direct. And the payments so to he made shall be charged
upon and payable out of the sums so borrowed or applied as aforesaid.
7. The said Treasurer shall, in his accounts from time to time,
be allowed credit for every sum of money paid by him in pursuance of
such warrant or order in writing as aforesaid. And the receipt of any person to whom the same shall be so paid shall he a full and valid discharge to the said Treasurer in passing his said accounts for each sum therein mentioned, and lie shall receive credit for the same accordingly.
8. Nothing in this Act contained, or in the Act forty-two Victoria, number sixteen, shall authorize the use of any money borrowed thereunder for works or services other than those named therein, and approved by Parliament in terms of the Act fifty-one Victoria, number thirty-seven.
9. From the several unexpended balances of moneys raised or to he raised pursuant to the "Public Works Loan Act of 1881" the
appropriations
appropriations hereinafter specified, shall, notwithstanding anything in the said Act to the contrary, he made for the purposes hereunder respectively declared, viz :—
(I) From the unexpended balance of the sum of seven hundred and five thousand five hundred pounds appropriated by the
" Public Works Loan Act of 1884" for the construction of a
Railway from Orange to Molong via Borenore, and Borenore to Forbes via Cudal, a sum not exceeding three hundred and ninety-seven thousand four hundred and ten pounds is hereby authorized to be applied to the construction of the Railway from Molong to Parkes and Forbes, sanctioned by the "Molong to Parkes and Forbes Railway Act of 1890,"
(II) Prom the unexpended balance of the sum of one million nine
hundred and eighty thousand pounds appropriated by the
" Public Works Loan Act of 1881" for the construction of a
Railway from Grafton to the Tweed River via Casino, Lismore, and the Brunswick, a sum not exceeding eight hundred and sixty-seven thousand three hundred and fifty pounds is hereby authorized to be applied to the construction of the Railway from Lismore to the Tweed River, as sanctioned by the "Lismore to the Tweed Railway Act of 1890."
(III) Prom the unexpended balance of the sum of eight hundred and four thousand pounds appropriated by the " Public Works Loan Act of 1881" for the construction of a Railway from Kiama to Jervis Bay, a sum not exceeding three hundred and eighty-one thousand three hundred and ninety pounds is hereby authorized to be applied to the construction of the
Railway from Kiama to Nowra, sanctioned by the " Kiama
toNowra Railway Act of 1890."
10. This Act may be cited as the " Loan Act of 1890."
