seven shillings and three-pence and to author ize t he application of t he sum of Fifty-four thousand t h r ee hundred and seventy pounds twelve shill ings and n ine-pence being the a m o u n t over-raised unde r cer tain Loan Acts enumera t ed in t h e Schedule here to and remain ing unexpended for t h e several purposes hereinafter specified Be it therefore enacted by t h e

of t h e Legis la t ive Council and Legis la t ive Assembly of N e w Sou th
W a l e s in P a r l i a m e n t assembled and by t h e au thor i ty of t he same as
fo l lows:—

1. I t shall be lawful for t h e Governor wi th t he advice of t h e Execu t ive Council to raise by t he sale of debentures secured upon t h e Consolidated R e v e n u e F u n d of t he Colony and bear ing interest a t a r a t e n o t exceeding five per centum per a n n u m such several sums of money no t exceeding in t he whole t h e sum of Four h u n d r e d and six t housand eight h u n d r e d a n d s ixty-three pounds seven shill ings and three-pence as m a y toge ther wi th t h e said unexpended sum be required for t he purposes hereinafter specified A n d the said unexpended sum of Fifty-four thousand three h u n d r e d and seventy pounds twelve shil l ings and nine-pence shall be applied together w i th the said s u m of Four h u n d r e d and six t housand e ight hund red and s ixty- three pounds seven shil l ings a n d three-pence to t he several purposes follow­ ing t h a t is to say :—

2. The sum of Twenty- two thousand pounds hereby granted for
t h e repair of t he Mudgee Road shall be repaid by t h e sum of Three

thousand pounds per a n n u m in t h e m a n n e r following t h a t is to

say by apply ing the sum of Three thousand pounds per a n n u m to t h e
purchase and cancellat ion of Government Deben tu res instead of apply­
ing t h e said s u m annua l ly as heretofore to t he repairs of t he said Road

un t i l t h e said Loan of Twenty- two thousand pounds be ext inguished.

3. A l l sums borrowed or authorized to be applied unde r th is

A c t shal l be paid to t he Colonial Treasurer and shall be by h i m placed to a separate credit to be called " The Loan F u n d " and no par t of t h e money so borrowed shall on any pre tence be paid used or applied direct ly or indirect ly ei ther temporar i ly or otherwise to or for any publ ic purpose o ther t h a n the purposes respectively to which the same is hereby directed to be applied.

4. The said Treasurer shall issue and pay the said several sums for t h e purposes hereinbefore ment ioned in such m a n n e r and in such propor t ions as t he Governor by any warrant or order in wr i t ing under his h a n d a n d directed to t he said Treasurer shall from t ime to t ime order and direct A n d the paymen t s so to be m a d e shall be charged upon and payable out of t he sums so borrowed or applied as aforesaid.
5. The said Treasurer shall in his accounts from t ime to t ime

be allowed credit for every sum of money paid by h i m in pur suance

of

of such w a r r a n t or order in wr i t ing as aforesaid A n d t h e receipt of each tod every person to w h o m t h e same shall be so paid shal l be a full and valid discharge to the said Treasurer in passing his said accounts for each s u m there in men t ioned and he shall receive credi t for t h e same accordingly.

6. This Ac t m a y be cited as t h e " Loan A c t of 1872 ."
