REGULATIONS UNDER THE AUSTRALIAN MEAT AND LIVE-STOCK CORPORATION ACT 1977*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Australian Meat and Live-stock Corporation Act 1977.

LIVE-STOCK PRODUCERS CONSULTATIVE GROUP (TEMPORARY PROVISIONS) REGULATIONS

Citation

1. These Regulations may be cited as the Live-stock Producers Consultative Group (Temporary Provisions) Regulations.

Interpretation

2. In these Regulations—

“ Chairman ” means the Chairman of the Group;

“ Corporation ” means the Australian Meat and Live-stock Corporation established by section 6 of the Act;

“ Group ” means the Live-stock Producers Consultative Group established by section 41 of the Act;

“ member ” means a member of the Group;

“ the Act ” means the Australian Meat and Live-stock Corporation Act 1977.

Members

3. (1) For the purposes of sub-section 43 (2) of the Act, the number of members shall be 22.

(2) The members shall be appointed by the Minister on nominations made in accordance with these Regulations.

(3) For the purposes of sub-regulation (2), the associations referred to in column 1 of the following table may nominate to be members, the number of persons specified in column 2 of that table opposite to the reference to the association:

(4) Where a person appointed to be a member by an association referred to in column 1 of the table in sub-regulation (3)—

(a) resigns in accordance with sub-regulation (6); or

(b) ceases to be a member by reason of his appointment to be a member of the Corporation,

that association may nominate another person to be a member.

(5) For the purposes of sub-regulations (3) and (4), a nomination under these Regulations shall be made in writing to the Minister.

(6) A member may resign his office by notice in writing given to the Chairman.

(7) A member appointed under these Regulations shall cease to be a member—

(a) on the declaration of a poll conducted for the election of members of the Group under regulations made under the Act; or

(b) on being appointed to be a member of the Corporation.

Chairman

4. (1) The Minister may appoint a member to be the Chairman.

(2) The Chairman may resign his office by notice in writing given to the Minister.

(3) The Chairman holds office until—

(a) he resigns;

(b) he ceases to be a member; or

(c) another person is appointed to be Chairman in his stead.

Meetings

5. (1) Meetings of the Group shall be held at such times as the Group determines and at such further times as the Chairman fixes by giving not less than 7 days notice in writing to each other member.

(2) For the purposes of sub-regulation (1), the Chairman may give notice of a meeting by post to another member.

(3) At a meeting of the Group—

(a) 15 members form a quorum;

(b) the Chairman or, in his absence, another member elected by the members present to act as chairman of the meeting shall preside;

(c) all questions shall be decided by a majority of votes of the members present and voting; and

(d) the member presiding has a deliberative vote and, in the event of an equality of votes on any matter, a casting vote.

(4) The Group may invite a person to attend a meeting of the Group for the purpose of advising or informing the Group on any matter.

(5) The exercise of a power or the performance of a function by the Group is not invalidated by reason only of there being a vacancy in the membership of the Group.
