I, ROBERT LINDSAY COLLINS, Minister for Primary Industries and Energy, make the following Orders under the Export Control (Orders) Regulations.

1.     Amendment

1.1      The Livestock Export (Merino) Orders are amended as set out in these Regulations.

[NOTE:  These Orders commence on gazettal: see Acts Interpretation Act 1901, ss.46 and 48.]

2.   Order 4 (Interpretation)

2.1   Suborder 4.1:   

Omit “Orders—”, substitute “Orders, unless the contrary intention appears:”.

1. Livestock Export (Merino) Orders No. 2 of 1994                   

2.2    Suborder 4.1 (definition of “consignment”)

Omit the definition, substitute:

“‘consignment’ means a consignment or intended consignment of one or more merinos to one export destination by one exporter.”.

3.     Order 5 (Export of merino rams, merino reproductive material and merino ewes, ova and embryos prohibited)

3.1     Suborder 5.2: 

Omit the suborder, substitute:

“5.2        The export, except to New  Zealand, or for a scientific research project, of a merino or of reproductive material is prohibited unless the  Secretary  allows  an  exemption under order 8.”.

4.     Order 8 (Exemption from prohibition)

4.1     Paragraph 8.2 (d):

Omit the paragraph, substitute:

“(d)  if a merino is purchased at a public auction or sale for consignment for slaughter in an overseas country (except New Zealand), whether the intending exporter has  completed a statutory declaration:

(i)   stating that the merino is for slaughter; and

(ii)   specifying the country to which the merino is to be consigned; and

(iii)  setting out the purchase price of the merino;”. 

4.2     Suborder 8.2:

Omit “the merino rams or”, substitute “a merino or of”.
