Regulations 1997

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to prescribe forms of returns and invoices relating to the sale of sheep and goats.

2. Authorising provisions

These Regulations are made under sections 95 and

139 of the Livestock Disease Control Act 1994.

3. Commencement

These Regulations come into operation on 1 July

1997.

4. Principal Regulations

In these Regulations, the Livestock Disease
Control Regulations 19951 are called the Principal

Regulations.

5. Return

Livestock Disease Control (Amendment) Regulations 1997

After regulation 36 of the Principal Regulations,
insert—
"(2) For the purposes of section 95(1A) of the

Act a return form for the sale of sheep or goats must—

(a) be in writing and set out—

(i)  the number of sheep and goats sold;

(ii)  the amount of sheep and goat stamp duty deducted;

(iii)  the month to which the return relates;

(iv) the number assigned under section 94(3) of the Act; and

(b)

be verified by the person making the return setting out their name, address and signature on the foot of the return.".

6. Form and particulars of invoice

After regulation 37 of the Principal Regulations,
insert—

"(2) An invoice issued under section 95(5A) of

the Act must be in writing and must contain

the following particulars—

(a) the date of the sale;

(b)

the pen number of the sheep or goats sold;

(c) the number of sheep or goats sold;

(d)

the age, sex and class of the sheep or goats sold;

(e)

the price paid for each head of sheep or goat;

(f)

the name of the person who purchased the sheep or goats;

(g)

the name and address of the person who sold the sheep or goats.".
