I, the Minister for Planning and Infrastructure, make the following local environmental plan under the Environmental Planning and Assessment Act 1979.

Liverpool Local Environmental Plan 2008 (Amendment

No 12)

under the

Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Liverpool Local Environmental Plan 2008 (Amendment

No 12).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

(1)

To the extent that this Plan rezones land from Zone R2 Low Density Residential to Zone RE1 Public Recreation (and makes corresponding changes to lot size, floor space ratio and height of building controls), it applies to 36, 41 and 118 Newbridge Road and 53 Rickard Road, Moorebank.

(2)

To the extent that this Plan rezones land from Zone SP2 Infrastructure (Classified Road) to Zone R2 Low Density Residential (and makes corresponding changes to lot size, floor space ratio and height of building controls), it applies to certain land adjacent to the M7 Motorway and Hoxton Park Road, Hoxton Park.

To the extent that this Plan rezones land from Zone SP2 Infrastructure (Classified Road) to Zone R3 Medium Density Residential (and makes corresponding changes to lot size, floor space ratio and height of building controls), it applies to Lot 1, DP 1148521, 616 Hoxton Park Road, Hoxton Park.

To the extent that this Plan varies a minimum lot size control, it applies

to 221 Hoxton Park Road, Cartwright.

(5)

To the extent that this Plan reclassifies public land from community to operational land, it applies to land at Cartwright, being 1A Bellbird Place and 13 Kemira Place (Lots 709 and 708, DP 238939, respectively).

To the extent that this Plan allows development for the purposes of rural supplies and secondary dwellings, it applies to land in Zone RU1

Primary Production and Zone RU4 Primary Production Small Lots under Liverpool Local Environmental Plan 2008 (the Principal Plan).

(7)	To the extent that this Plan provides for advertising in or on bus shelters as exempt development, it applies to all land to which the Principal Plan applies.
(8)	To the extent that this Plan corrects a locality description, it applies to 20 Webster Road, Lurnea (previously referred to as being in Liverpool).

Each map adopted by Liverpool Local Environmental Plan 2008 that is specified in Column 1 of the following table is declared by this Plan to be amended or replaced, as the case requires, by the map specified opposite in Column 2 of the table as approved by the Minister on the making of this Plan:

[1]      Land Use Table

Insert “Rural supplies; Secondary dwellings;” in alphabetical order in item 3 of the matter relating to Zone RU1 and Zone RU4.

[2]      Schedule 2 Exempt development

Insert the following after the matter relating to Advertisements—business identification signs in rural zones:

Advertisements—in or on bus shelters

(1)

Maximum height—2.5m.

(2)

Maximum width—1.5m.

(3)

2 signs per bus shelter.

(4)

Must not be flashing.

(5)

Must have the consent of the owner of the property on which the

sign is located.

Omit “Nil” from Column 1 of Part 1.
