Listening Devices Regulations 2004

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Listening Devices Act 1991 .15 November 2004

1Short titleThese regulations may be cited as the Listening Devices Regulations 2004 . 2CommencementThese regulations take effect on 1 January 2005. 3Interpretation (1)  In these regulations – the Act means the Listening Devices Act 1991 . (2)  In these regulations, a reference to a form quoted by a numeral is to be construed as a reference to the form that is so numbered in Schedule 1 . 4Complaint under section 17 of ActA complaint under section 17 of the Act made to a magistrate for the purpose of obtaining a warrant to authorise the use of a listening device is to be in accordance with Form 1. 5Warrant under section 17 of ActA warrant granted under section 17 of the Act to authorise the use of a listening device is to be in accordance with Form 2. EXPLANATORY NOTE

(This note is not part of the regulation) These regulations replace the

(a) prescribe the form of complaint to be used for the purpose of obtaining a warrant authorising the use of a listening device; and (b) prescribe the form of that warrant.
