I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Lismore Local Environmental Plan 2012 (Amendment No 19).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to an approximately 2-hectare part of the south-eastern corner of the land at 354 Broadwater Road, Dungarubba, being part of Lot 2, DP 8877.

4      Maps

The maps adopted by Lismore Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

Schedule 1 Additional permitted uses

Insert after clause 3:

4      Use of certain land at Broadwater Road, Dungarubba

(1) This clause applies to an approximately 2-hectare part of the south-eastern corner of the land at 354 Broadwater Road, Dungarubba, being part of Lot 2, DP 8877 and identified as “Item 4” on the Additional Permitted Uses Map.

(2)

Development for the purpose of industry (limited to the manufacture of

concrete fence posts) is permitted with development consent.

(3)

The consent authority must not consent to development referred to in subclause (2) unless a condition is imposed that requires the development to cease no later than 5 years after the date on which development consent is first granted in respect of the development.
