CaseChat Overview and Summary
The court examined the legal framework surrounding the jurisdictional objection. It noted that under the Fair Work Act 2009, small businesses with fewer than fifteen employees are not subject to the same unfair dismissal provisions as larger employers. In this instance, the respondents argued that they had fewer than fifteen employees, thus exempting them from the unfair dismissal jurisdiction of the court. The court had to weigh this argument against the applicant's claim, which alleged that the termination of her employment was unjust and in breach of her rights.
Upon reviewing the evidence and submissions, the court concluded that it lacked jurisdiction to hear the case due to the respondents' small business status. The court found that the minimum employment size requirement was not met, and therefore, it could not proceed with the unfair dismissal claim. Consequently, the court dismissed the application for lack of jurisdiction. The court did not rule on the merits of the applicant's claims, as it determined that the jurisdictional bar was a sufficient ground for dismissal.
