Termination of employment - jurisdictional objection – small business - minimum employment period not served.

[1] Further to the decision and reasons given in transcript on 13 March 2013, I find that

Summit Publishing is a small business within the meaning of s.23 of the Fair Work Act 2009 (the Act) and that the minimum employment period of 12 months, as required in s.383(b) of the Act, was not served by the Applicant.

[2] The application is dismissed and I so order.
