AN ACT to prevent the sale, by Unlicensed Persons, of

Spirituous and Fermented Liquors.

[ 12th January, 1871. ]

HEREAS the sale of Spirits by unlicensed persons, under Spirits for others residing in the country, is a serious and growingW pretence that they have received commissions to purchase

evil in this Colony; And whereas it is expedient to prevent such sales under such pretences ; Be it therefore enacted, by the Governor of Western Australia and its Dependencies, by and with the advice and consent of the Legislative Council thereof:—

1 THAT it shall be lawful for any Justice of the Peace, upon an information being laid before him that any unlicensed

suspected of selling spirits, &c., without a license, to be

person or persons is or are suspected of selling or otherwise dis-

affixed on Court House or

posing of spirituous or fermented liquors, upon proof to the

Police Station, or otherplace

satisfaction of such Justice that such person or persons has or have

been previously convicted of a like offence, to cause to be affixed or posted up on the Court House door, Police Station, or some other conspicuous place in his district, a list of the name or names of persons so suspected of selling spirituous or fermented liquors in the manner above stated.

2 THAT it shall be lawful for any police officer or constable

THAT upon complaint being made to a Justice of the Peace,

the spirits or fermented liquors so seized to be forfeited, and in addition, to impose a fine, not exceeding Fifty Pounds (to be recovered before any one or more Justice or Justices of the Peace), upon any such unlicensed person or persons on whose person or in whose cart, dray, or vehicle the same may be found.
