Regulations under the Liquor Ordinance (No. 3) 1975.*

I, G O R D O N M U N R O BRYANT, the Minister of State for the Capital Territory,
hereby make the following Regulations under the Liquor Ordinance (No. 3)
1975.

LIQUOR REGULATIONS

PART I—PRELIMINARY

1. These Regulations may be cited as the Liquor Regulations.

2.    (1) In these Regulations, unless the contrary intention appears—

" meeting " means a meeting of the Board; " member " means a member of the Board; "Ordinance" means the Liquor Ordinance (No. 3) 1975.

(2 ) A reference in these Regulations to a form by number shall be read as

a reference to the form so numbered in the Schedule.

(3 ) A form in the Schedule shall be completed in accordance with the

instructions contained in the form.

PART I I — F E E S AND ALLOWANCES TO M E M B E R S OF BOARD

3. ( 1 ) The Chairman shall be paid for each day on which he attends a

meeting—

(a) if the meeting continues for not less than 3 hours—a fee of $60; or

(b) if the meeting continues for less than 3 hours—a fee of $40.

( 2 ) Subject to sub-regulation ( 5 ) , a member other than the Chairman shall be

paid for each day on which he attends a meeting—

(a) if the meeting continues for not less than 3 hours—a fee of $50; or
(b) if the meeting continues for less than 3 hours—a fee of $30.

( 3 ) Subject to sub-regulation ( 5 ) , there is payable to the Chairman for each day on which he is engaged, with the approval of the Board, on business of the Board that does not include normal preparatory work for a meeting—

(a)

if the period during which he is so engaged is not less than 3 hours— a fee of $60; or

(b)

if the period during which he is so engaged is less than 3 hours—a fee of $40.

(4 ) Subject to sub-regulation (5 ) and regulation 5, there is payable to a member other than the Chairman for each day on which he is engaged, with the approval of the Board, on business of the Board that does not include normal preparatory work for a meeting—

(a)

if the period during which he is so engaged is not less than 3 hours— a fee of $50; or

(b)

if the period during which he is so engaged is less than 3 hours—a fee of $30.

( 5 ) Where the Chairman or a member other than the Chairman—

(a) attends a meeting; and

(b) is also, on the same day, engaged, with the approval of the Board, on other business of the Board,

a fee is not payable to him in accordance with sub-regulation (3 ) or (4 ) for the period of engagement referred to in paragraph (b) but the fee payable to him for that day in accordance with sub-regulation (1 ) or (2 ) is the fee that would have been payable to him for that day if the meeting referred to in paragraph (a) had continued for a period equal to the aggregate of the period of the meeting and the period of engagement on business referred to in paragraph ( b ) .

4. ( 1 ) Subject to regulation 5, where the Chairman or a member other than the Chairman is necessarily absent overnight from his place of residence—

(a) in order to attend a meeting; or

(b)

in order to perform other business of the Board on which he is engaged with the approval of the Board,

travelling allowance, at the rate of $37 per day, is payable to him in respect
of his period of absence.

( 2 ) Travelling allowance under sub-regulation (1 ) is payable in addition to, and does not include, the cost of conveyance.

5. Fees and allowances are not payable in accordance with these Regulations

t o —

(a)

the member holding office under paragraph 7(1) (c) of the Ordinance; or

(b) a person appointed to act in the place of that member.

PART I I I — F O R M S

6.   An application for—

(a) a General Licence;
(b) an On Licence;
(c) an Off Licence; or
(d) the approval of the Board to the alteration of licensed premises,

shall be in accordance with Form 1.

7.   An application for the approval of the Board to a transfer of—

(a) a General Licence; (b) an On Licence; or (c) an Off Licence,

shall be in accordance with Form 2 and shall be accompanied by the records kept for the purposes of section 100 of the Ordinance, being records up to the date of the application.

8. An application for a Club Licence shall be in accordance with Form 3.

9. A n application for the approval of the Board to the transfer of a Club Licence shall be in accordance with Form 4 and shall be accompanied by the records kept for the purposes of section 100 of the Ordinance, being records up to the date of the application.

10.    (1) The prescribed form of—

(a) a General Licence; or
(b) an On Licence,

for the purpose of section 36 of the Ordinance is Form 5.

( 2 ) The prescribed form of a renewal of—

(a) a General Licence; or

(b) an On Licence,

for the purpose of section 39 of the Ordinance is Form 5.

11 . ( 1 ) The prescribed form of an Off Licence for the purpose of section 36 of the Ordinance is Form 6.

( 2 ) The prescribed form of a renewal of an Off Licence for the purpose of section 39 of the Ordinance is Form 6.

12. ( 1 ) The prescribed form of a Club Licence for the purpose of section 36 of the Ordinance is Form 7.

( 2 ) The prescribed form of a renewal of a Club Licence for the purpose of section 39 of the Ordinance is Form 7.

13.   An application for the renewal of—•

(a) a General Licence; (b) an On Licence; or (c ) an Off Licence,

shall be in accordance with Form 8.

14. A n application for the renewal of a Club Licence shall be in accordance with Form 9.

15. An application under regulation 13 or 14 shall be accompanied by a certificate in accordance with Form 10.

16. A n application under regulation 13 for the renewal of an Off Licence shall also be accompanied by a certificate in accordance with Form 11.

17. The prescribed form of an application under section 62 of the Ordinance for the grant of a permit is Form 12.

18. The prescribed form of a permit for the purpose of section 65 of the Ordinance is Form 13.

19. The prescribed form of memorandum for the purpose of section 42 of the Ordinance is, in the case of—

(a) a General Licence; (b) an On Licence; or (c ) an Off Licence,

Form 14.

20. The prescribed form of memorandum for the purpose of section 42 of the Ordinance is, in the case of a Club Licence, Form 15.

2 1 . The prescribed form of certificate for the purpose of paragraph 99 (3 ) Ob) of the Ordinance is Form 16.
